Hi.

What happens when the lifting of conditions has been submitted, and immigrant spouse now wants a divorce? Check has been cashed and NOA1 has been received.

Apply for divorce and submit a divorce waiver application. USCIS will then ask for a final divorce decree. The green card holder can then apply for citizen 90 days before the 5th anniversary of the green card (as opposed to the 3rd if still married to the US citizen). :)

Just my thoughts, be easiest to wait until the ROC petition is complete, then finalize the divorce. And, sometime later file the N-400. Provided no adverse events have taken place there shouldn't be any problem along the way. Best of luck!

Is the USC still on the hook for the I-864?

Since it appears the divorce is right after the GC filing what can he do to protect himself (if anything)?

(parenthetical comment about how many of these cases are related to Philippino spouses removed by me)

Maybe you should talk to each other and figure out whether she wants to go back to the Philippines, or wants to stay in the U.S.

If she stays in the U.S., you're still obligated under the I-854 you signed if she receives any public assistance, until she gets her citizenship (in 5 years from the date she arrived, if you divorce). And you might be ordered by a divorce court to give her spousal support (alimony).
