Hi everyone. I was under K-1 but was married last July 2015. My question is, can I petition my daughter? I believe that I wasnt able to place her name on my K-1 application because I was still undecided if I'll bring her right away or not. Can anyone help me about this? Because my daughter finally decided that she wants to stay here with me. Btw, she is only 10 yrs old. Thank you un advance for your help and opinion!?

your husband should file for her, it is quicker as he is a USC, the petition will take a year

if you file for her, the petition will take 2 years

what about her father, do you have custody of your child?

Thank you for the quick response.

My daughter was from a past relationship. Her dad and I was never married but my daughter carries her last name. My daughter doesnt received any kind of support from her father.

What do you think would be the safest way to do in her case?

then by your countries law she is only your child so no problem of custody there

have your husband file for her as her stepfather

it is faster because he is a USC

We havent done that yet, but we can do that really soon.

So, all he needs to do is adopt her and he could petition my daughter within a year? Do i got it correct?

no, he doesn't need to adopt her, he will file as stepfather

if she would have come with you on a K2, once you were married, she would have adjusted status because her stepfather petitioned her

since she didn't come with you, he will file the i130 for her to come as his stepdaughter

no need to adopt her

Ohhh okay. So he needs to file for i130 and state there that he will file as a stepfather. Bit confusing now since its been awhile since I filed for that for my K1. But ill make sure Ill understand it so we can file asap.

Read the instructions on I130 it's all there filing for step children. My husband petitioned for my kids we are going through the process as we speak. Good Luck

If your K-1 visa was issued less than a year ago, she can follow to join on K-2.

Hi .We are planning to petition my son too hopefully, with in this year. May I know what's the name of the visa?
