Traveling With Expired 2 Years Green Card Visa

Hi Guys I have Few Question:

I'm a US Citizen and my wife has a 2 years permanent resident card which expired on 12/27/15, we filed I751 application to remove conditional residency & she went to have her biometrics taken. We're both waiting for her new 10 years permanent resident card or interview.

After we filed I751 we received a letter I-797 notice of action prior to her biometrics which stated: Your conditional resident status is extended for a period of one year. During the one year extension you are authorized employment and travel.

We wanted to go home to Philippines to see her family for 3 Months, however after some discussion we are afraid she will not be able to come back. Immigration officers in the D.R. are difficult to deal with and we are debating on what to do. We bought the tickets already but I'm also afraid that we might get an Interview date while we're in our Vacation. If that SO i don't know what to do. Do i need to cancel our Ticket and wait for her new GC to be arrive?

What if we get a Letter From USCIS Stating there is an Interview and were both in the Philippines? This means we have to come back to US and be in that interview. Can i make re-appointment the Interview date?

It could take anywhere from 6 months to a year (sometimes even longer).

Does this mean she can leave the country?

Yes

What if we get a Letter From USCIS Stating there is an Interview and were both in the Philippines? This means we have to come back to US and be in that interview. Can i make re-appointment the Interview date?

Yes, you would have to come back for the interview. It's possible to re-schedule but you would need a good reason.

It could take a year or so for USCIS to adjudicate the I-751.

As the NOA letter states, her LPR status is extended by a year for all purposes, including employment and foreign travel. Her original (expired) green card and original extension letter/NOA (not a copy) will be enough for her to re-enter the US.

Yes, you and your asawa can leave the country as long as she has her expired green card and letter showing that it is extended for one year. Do not worry my wife and I traveled to the Philippines in July of last year and her green card was expired but we had the paperwork showing it was extended. She was not given any ####### at all about it.

Do you think there will be no more interview after biometrics last October 26,2015. She's waiting for almost three months now since they received her case. And we are planning to go home in Philippines this coming April but we don't know if they will approved her case or not.

if you sent enough proof of bona fide marriage, there is not supposed to be an interview

there is only an interview when they don't believe the marriage is real

unless you get an RFE requesting more evidence, if all goes well, she will receive the 10 year GC in the mail,

so if you travel, have someone take care of your mail

According to an immigration attorney whom I contacted during our ROC time, a certain number of petitions (5%, did he say?) must be pulled for interviews, by statute.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I remember the IO during my AOS interview saying something to that effect as well when my husband asked about whether we needed to go back for an interview for ROC.

I'd go on and go. If you receive a request for an interview, well, you can change your travel plans and come back, possibly with a break from the airlines if you explain the situation. You should be able to re-book a return trip if you need to with a small-ish fee.

These are the list that was in the package:

1.) Copy of her California ID with address Copy of my driver license with adress.

2.) Copy of our Costco membership cards

3.) Copy of her SSN card

4.) Copy of her passport and expired Green Card

5.) Copy of our Medical insurance Card.

6.) Copy of Life insurance policy indicating my wife as beneficiary

Copy of her life insurance policy indicating me as beneficiary.

7.) Copy of Joint Account in Saving and Checking in our Bank Account

8.) Copy of Statement of our bank of all the things we both buy

9.) Copy of her Credit and debit card. Blocking the number. Showing the name of her.

10.) Copy of both of our Tax Transcript from 2013 - 2015

11.) Copy of her Check From work.

12.) Copy of Zale Credit CArd showing my wife as beneficiary

13.) Copy of Plane Ticket. Showing her name. We went to Canada for 2 weeks vacation

14.) Affidavit of Letter with Notary Stamp in the letter. 2 friend and 1 for her boss.

15.) Lots of Photos:

A.) We bought a new Wedding ring. We took a picture.

B.) Christmas party. Her Birthday party. All the holidays

C.) Lots of picture when we go to Canada.

D.) lots of picture when we go Disneyland and Universal Studio

I Hope this is good enough to have a prove. Anything else important I'm missing.

I just travelled back and forth from Canada on my expired GC and i751 letter (1 year extension letter) yesterday.

How was your trip? Did you get any Problem Encounter like Leo7777 Mentioning about?
