After four months from Appeal EOIR-29 I got this update in my case:

Case Was Reopened

On January 19, 2016, we reopened your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, Receipt Number **************, and mailed you a notice. Please follow the instructions in the notice. If you do not receive your reopening notice by February 18, 2016, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Next Step:

We will mail our decision to you. The notice will explain any action you need to take.

To let you know my appeal still with USCIS officer and I contacted NCSC many times and made an INFOPASS but I got no response from them so two weeks ago I contacted my congressman to inquire about my appeal and I got this update on my case, please if anyone know what that update means?

Are they going to approve my case or what?

They are sending you a letter. When you receive it, you will know what's going on. Until then, it's a waiting game.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am in the same situation . My EOIR 29 was remanded back to the USCIS on 1/20/2016. I have contacted the USCIS since then several times and they tell that my case is with the BIA even though it has been remanded back to the USCIS. I mailed a letter to my congressman for assistance and received a reply that they would assist me but I haven't heard from them for a few weeks now. I think it won't harm you to ask them for help. It might be a good idea to ask them to expedite your case and see if that helps. They usually respond back in a maximum of 5 days.

P.S. Can you tell me how long did you wait between when you received your notice from the BIA and the one from the USCIS?

Hi Smarty18, I got two letters from USCIS office in Jan,24 2016 in one package. In 1st letter they reopened my case and deal with my appeal as a motion to reopen, second letter was approval notice.

My Congerssman helped me for that, I think one of main reasons for approval is when I wrote hole details about my case to congerssman let them know that they made mistakes on my case that I discovered 3 months later from my appeal

Keep on contacting your congerssman office and provide with details every week so that they can make BIA expedite your appeal.

What makes me hopeless is lawyers advices, thay all scared of dealing with cases especially when cases are required appeal, all of them told me to refile a new petition, No one stand with my appeal so I did it myself and I won.

Be patient if your case and marriage is real and still provide them with available documents. At the end they will approve it.

Thank you for that information. Did you get any written information from the BIA saying that your case was remanded back to the USCIS?

No, my case did not transfer to BIA, and the officer who denied my case reopened it and approved at the same time.
