My wife will be receiving a spousal visa. We are currently taking care of her niece and we will be moving to the states soon. Can we bring her with us with using a tourist visa or is there a better option?

your wife can definitely bring her niece on a tourist visa if her niece gets approved for the visa. Since your wife is taking care of her, chances of getting the tourist visa approval is almost zero.

For how long are you taking care of her?

If you have the money for tuition etc, how old is she?

From what I read, there is a possibility that should could enter with F-1 student visa but I need to look into it more. We might be taking care of her for more than a year.

Start looking for private schools to pay for now if you're thinking F1.

She is nine years old. I have looked into some things. She could only attend public schools if she were attending high school and we would pay tuition. Right now I am looking into good private schools.

I think you are really asking is a way for your niece to come and stay in the US without a proper visa. you are trying to see if she can get through on a visitors visa and just stay. That is immigration fraud, no one will answer that.

That's basically what he was asking, yes.

If she is going to move countries would not France be a more obvious location so she can be with her mother?
