Actually, I remember a few failed medical exams because of alcohol drinking in London...

Yes a few Canadians were also stopped from getting their visas because of past alcohol history.

And not exactly relevant to US immigration, but try getting across the Canadian border with an admitted DUI conviction. Canadians take that seriously.

Can a United States Immigration Law ever be challenged legally for being wrong? And obviously wrong would be an articulate argument from my position, but is it even possible to challenge in a court?

I only made it through judicial politics.

I only made it through judicial politics.

I doubt your pockets are deep enough nor do you have the many years to wait while the process runs it's course. The wheels of justice move very slowly and it takes a lot of grease to keep them turning. If the prior drug issues become a problem with his immigration, your best bet is to move there.

I'm going to assume that all of you who think drugs are not a big deal thinks marijuana is the only drug in the world.

Not at all. I have looked at this issue for decades. IMHO, the current policy and war on drugs is broken. We tried prohibition and it failed in an explosion of crime. The current prohibitions on drugs are attended by their own explosion in crime. Ultimately, with alcohol, smoking, sugar, and drugs it is an individual battle with our internal demons.

Why do you feel it's wrong?

I can't wait to be attacked for this, but a zero tolerance policy discriminates against responsible citizens. Millions of responsible American adults use, or have used drugs. The law does not reflect how our society conducts itself. Unless we're all just meant to lie to ourselves. Why shouldn't we revisit and revise laws to reflect times have changed? Just how rich do you have to be to buy lubricant for the wheels of justice?

I want to clarify to everyone who thinks I'm a horrible person and who probably thinks I don't want their fiance or spouse here... I'm talking about drugs in general and not just for immigration purposes.

Some people make silly mistakes when they are young and I think it's wrong to punish someone for something they did years ago if they are clean now. Yes, our war on drugs are completely wacky, it doesn't make sense that you can be sent to jail for life for trying Marijuana once. It doesn't make sense that you smoke marijuana once 10 years ago and you happen to be honest about it during a medical and your whole future with your fiance/spouse is in jeopardy. But yeah, I think that if you're still using you should stay in your home country and get treatment.

People think Marijuana is harmless but it's not. Sure it's got a lot benefits, especially for terminally ill cancer patients. But people don't realize how much damage it causes.

Sometimes life isn't fair. Here's a good one for you. I am 52 years old, I have an old possession of marijuana (2 joints) arrest on my record from 1986, I was 23. I have been pulled into secondary twice within the last 7 years because of it when attempting to cross the Canadian border to visit my then girlfriend, (now wife). Both times I was asked by the border guard if I had ever been arrested, I had to answer yes and tell him what for. I was eventually allowed entry each time, but I was questioned pretty intensely and had my vehicle searched both times.Things stay with you for life whether you like it or not.

where does all of the apathy come from? I mean, even the lawyers say no hope. So, a citizen has to be rich to challenge the law, that's disgusting. I'm sure even people working within the government wish the laws for drugs were flexible. Zero tolerance defies human nature. Zero tolerance for drugs is a zero tolerance for humanity. It makes no sense.

The trouble is for your purpose they must be challenged at a federal level. For example, it's legal to smoke pot in Colorado, but say you're on a b2 and do so then go for an immigrant medical and admit to it it's still a banable offence despite legal in the state. That's where it gets costly.
