I have not seen many people's petitions denied. You would get an RFE requesting for more evidence before you're denied unless you have completely not met the requirements.

The two requirements are that you have met in the past two years before you petitioned and that you are free and legal to marry. If you've met those requirements, there's no reason you should be denied.

There's no reason to put unnecessary stress on yourself! Take some breaths and be patient.

Agreed. Assuming you met th two basic requirements to file, I wouldn't worry about it. If they need more information they will ask for it before they deny an application at this stage.

God Luck and stay positive!

Will the processing center deny a petition before it is sent to NVC? If so, how long will it take for them to notify the petitioner of reason? Or will the noa2 just read Denied?

To answer you of course USCIS can deny your petition. Denied petitions do not go to NVC. If denied you would be notified by USCIS by US Mail.

NOA2 would not be coming if there was a denial. You would get another I-797 Notice of action (We call the NOA2 an approval).

Is there a reason you are asking or just general information?

*** Thread moved from K-1 Process forum to the K-1 Case Progress subforum. ***

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey Kehinda, don't worry. I am October 26 and still not approved yet. I think it is cause this isn't our first rodeo with USCIS that it is taking longer and it doesn't help that they are from Nigeria, Boko Haram HQ, which is the deadliest terrorist organization in the world according to the Institute of Peace. Like the Nigerians say, It is well :-)

Also you won't just be denied. You will get a notice of intent to deny by certified mail. NOIDs have very strict response times. So even if you were going to be denied, you will get warning. From that I am seeing, it is almost impossible to deny at the USCIS level. They mainly get us at the DOS process because aliens have zero rights and the vagueness to deny is so broad.

Thanks Tomyka I feel much better after reading your response. Just knowing that I am not alone in the wait for nigerian filers.

Well I definitely meet the requirements and I am sure everything was signed so I'm worrying for nothing. It's probably because this is my second rodeo.

Hey Stop that . You are not getting Denied.

Your NOA 2 is coming very soon.

I just checked IGOR'S list you are just one of the last for early November NOA 1.

Just think how relieved you will be when you get the email/TEXT of approval.

It is coming, it is written!

Tyler

Hello Tyler, my friend. You caught me worrying. Lol..I'm not worrying anymore though, I promise. I feel much better after reading these post.

Also I read the other day that the FBI was backlogged due to the significant increase in gun sales. FBI provides background checks to lots of other agencies as fee for service. So we could be experiencing that backlog, add in the second time around where they could have initiated a field investigation to make sure our boos aren't already married, added they probably need to thoroughly check terrorist databases and maybe some ground checks too.. Perfect storm for delayed approval. I think it is better delayed now versus at interview or AOS. I googled my alternate name spelling and there is a girl with my similar name committing all kinds of crimes lol. Bad thing is that she is in my birth state and three years older than me. That all has to be resolved first too.
