Less than half that based on 44,928,381 nonimmigrant admissions in 2015.

And some of those overstays are still leaving.

The rate for VWP countries is 0.65% and non VWP 1.6%

Thanks that was interesting. It's also interesting how different news outlets write their headlines for this report.

NY Times: "Few Foreign Visitors to U.S. Overstay Visa, Federal Report Says"

vs

USA Today: "Nearly 500K foreigners overstayed visas in 2015" which seems more sensationalist.

But then again newspapers are in the business of selling newspapers...

Odd, in 2013 it was over 60m and going up.

But what do they deem a overstay? I doubt if they counted all the people who overstayed than got married and than adjusted status.

Like you said HFM181818 if they would stop the loophole of adjusting status from a Visitor Visa/VWP/ESTA that would I am sure really change some things.

I mean why is it so hard to make the beneficiary have to go back to their country. People filing waivers have to do it? Sorry just talking aloud.

Based on the methodology used for the study, they have all sorts of fine grained data about the demographics of the overstayers.

Annoyingly, I cannot find anything. It would be nice to validate the in-country and anecdotal survey (95+% non return for certain demographics) with the more reliable data gathered by DHS.

the report is missing some key elements....like those who have the ever popular mind change at baggage claim, whether to get married to the porter or to attend classes at some No-Nam-o 'university or to join an ESL program....sorry, but anyone who can, ten minutes after arriving in the US, alter their lives so dramatically, had to have been an intending immigrant....that is why I firmly believe, as so many of you know, that Congress should, without costing us taxpayers a penny, end all AOS/COS from B2, F1, H3, J1 visas. Otherwise, these visas just are devices to be used and abused to avoid scrutiny and to get one of these visas by saying one thing, but doing another. Yea yea...we keep hearing about how people should be allowed to change their mind...fine....but end the possibility of changing their status! If they really want some other visa or status, go back home and apply for it there. you still get to change your mind, but now you will have to further demonstrate your bona fides.

But what about those who have a genuine cause to stay and adjust?
