Hi

Once I become a citizen I'll be planning on petitioning for my parents.

My question however is my siblings are only under 14 years old when I become a Citizen they'll be around the ages of 10 - 20

When I petition for my parents [i have been told it takes 1 - 2 years for petitioning for U.S. Citizens parents, can anyone confirm?], are my siblings eligible to come with them?

Or do my parents have to petition for their own children (my siblings) when my parents get to the U.S. as PR's?

Yes, it will take just over a year to get the parents here.

No, your siblings cannot come with them. What many families do is petition one parents, who then comes here and starts working, and petitions the other parent and kids.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Would it take longer for her to petition for her children (my siblings) or about the same time?

I as a PR cannot currently petition for my parents right? I need to wait to become a Citizen, right?

Even if my siblings are under 18 years old and are children? When a USC petitions a parent, only the parent can get a visa. Children are not allowed. There is no way around this.

So if I petition for my mother she comes and than petitions as a PR for my father and siblings? Yes. One parent comes first and petitions the other parent and children. The children can come IF their CSPA ages are under age 21 when the Priority Date becomes current, and they are unmarried. You mentioned 10-20 as the age for your siblings when you will become a USC. A 20 years old would not qualify as a derivative beneficiary by the time your parent gets a green card and a visa number becomes available. Since you aren't giving specific ages, that half answer is the best I can help you with.

I as a PR cannot currently petition for my parents right? As an LPR, you can not file for your parent. You must be a USC to file for a parent. I need to wait to become a Citizen, right? Yes.

The information above is based on processing for visas today. That will change in the future. By the time the first LPR parent comes, it could be longer than 1-2 years to petition for the other spouse. In the past, it has been over 5 years for very long periods of time.

What country are your parents and siblings from?

I'll qualify for Citizenship in 12/2018

If you are not a citizen yet, the 20 year old will definitely age out. The 17 year old might, depending on how long it takes you.

Would he even be eligible for CSPA possibly?

Would he even be eligible for CSPA possibly? No. He would be 24 years old in 2020 when an LPR parent can file for him.

Best case scenario.

You will become a US citizen in 2019. You petition your parent, and he/she arrives in 2020 and immediately file for his/her spouse and unmarried children.

In 2020, your siblings will be 19, 21, and 24.

The current wait for unmarried sons and daughters over the age of 21 petitioned by an LPR parent in the F2b category is 7 years. It can be as long as 10 years. They must remain single. There is nothing that can be done to get them here quicker.

The 19 years will be in the F2a category where the current wait is 1.5 years. However, it has been as long as 4-5 years. This child may immigrate in 1.5 years or it could take 10 if he/she ages out into the F2b category. There is nothing you can do to change this.

Howbout the 17 and 15 years olds?

He explained that by the time your parents can petition only 1 will have the chance of coming as a child. You can apply in 2018 , citizenship takes about a year, so you petition your parent in 2019 they arrive in 2020 and then they can file that adds 4 years to each of their ages and 2 have aged out. CPSA only applies to the age from when the petition is filed to when it is approved and doesn't help people that are too old. There is a chance that even the youngest one will age out before they come as a child depending on the waits when 2020 arrives.

This will not be over quickly. You will not enjoy this.
