My past crimes were done 26 years ago, and while they are felony convictions of burglary, (a non-violent offense). I have since then obtains two college degrees and have never committed another crime. I was also granted a pardon by the state, and the pardon was not conditional, which means all of my rights were restored. I have for over 26 years lived as a law-abiding citizen, and I do not fully understand why if I have to re-visit that long ago past especially since my offense is not mentioned below. I am trying to get some clarity on this as I am weeks away from sending my Fiance petition off. Does anyone have any factual information on this as to the clarity of this k-1 question below? Thank you in advance for the info.

The crimes in the K-1, (which I have included in this post below) does not have my crime listed.

  1. Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes (even if your records were sealed or otherwise cleared or, if anyone told you that you "no longer had a record")?
    • Domestic violence, sexual assault, child abuse and neglect, dating violence, elder abuse and stalking.
    • Homicide, murder, manslaughter, rape, abusive sexual contact, sexual exploitation, incest, torture, trafficking, peonage, holding hostage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint, false imprisonment or an attempt to commit any of these crimes.
    • Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

The disclosure of past convictions for certain crimes is part of the IMBRA law. It ONLY pertains to the types of crimes that are stated in the instructions and on the form. Theft/burglary is not among them. You are free to check NO for all 3 of those questions, Part 3 #2a-c.
