I am asking this for my stepson. He has been a US citizen for about two years now. He married his wife in Colombia about a year ago. Just last month she gave birth to their son. I know he needs to apply for a visa for her but what about the baby? What is the process for bringing the child to the US? Thank you.

Again, looking for advise for my stepson on bringing his wife and child to the US, He is a naturalized US citizen. He received his citizenship about two years ago. We are trying to get the CRBA but he is having trouble proving that he was present in the US for the previous 5 years. He has proof for the last three years but having worked "under the table" for several years he has no employment records, no tax records, no social security records for the years before he went legit. Any ideas on other forms of proof? And what does he need to do if he can't provide the proof? Thanks again for your help.

First, it doesn't have to be the "previous" five years -- it is any five years prior to the birth of the child. Two of those years have to be after the US citizen parent was over the age of 14. And, it doesn't have to be "proof". The standard is a "preponderance of the evidence", i.e., that it is more likely than not that what he has written in the Affidavit of Physical Presence (a sworn statement) is true. So -- does he have anything like a lease/contract/receipts for housing? Did he take any courses or go to school anywhere and have transcripts/report cards/certificates? Does he have mail (birthday cards, other special occasion cards) sent to him at an address in the US -- with the envelopes that show when they were sent/received? Any medical records, including shot cards?

Even if he thinks he can't provide the necessary documentation, he needs to file for the Consular Report of Birth Abroad. If he doesn't, and just files for the immigrant visa, the consular officer will suspended activity on the visa application, when it reaches that point, until it is determined that the baby is not a US citizen. They need to know that before a visa could be issued, since they can't issue a visa to a U.S. citizen.

In order for the baby to enter the US on US Passport, your stepson has to apply for CRBA or Consular Report of Birth of a child born to a US Citizen parent(s) abroad. He or her wife has to file it at the US Embassy in Colombia.

If it's hard to prove, he can apply for an immigrant visa for the child. That way, the moment the child passes POE with the immigrant visa, he becomes a citizen.

Can he provide domicile records ... any bills, pieces of mail, sent to previous addresses ... anything that would show he lived in the US. Any government organization that may have asked for his address that may have records of his name tied to an address ... etc. this may help, but not entirely sure
