wondering why the Dallas Service center has scheduled a much higher percentage of interviews. Seeing things that likely don't exist as the wait drags on. :lol::clock:

You can also go to an IRS office and they should be able to print them out for you.

HI everyone,

I had my interview at Federal Plaza in NYC yesterday and here is how it went.

My appointment was at 2:10pm, I showed up at 1:50 and got called at 2:20.

The IO was very professional and started off by verifying my identity (I gave her my GC, DL and my 2 passports - expired and current). After verifying my name and DOB she went on to ask me civic questions:

- What is the ocean on the West coast?

- Why are there 13 stripes on the flag?

- What is the name of the national anthem?

- What happened on 9/11/01?

- What is the rule of law?

- How old does a citizen have to be to vote for president?

She then asked me to read on sentence and write the answer down.

All of this went well.

She then started to go over the application and asked me all the addresses I've lived at in the past 5 years. I did move a lot (I moved every year, never renewed a lease) and did not review the application before the interview... so I struggled a little to remember one of the addresses ;-) She was ok with it though and let me take my time!

Then comes the question about arrest/detention. I disclosed a speeding ticket I got in 2013 while I was living in Houston. To avoid having a record at the time, I did a deferred disposition (not sure you can do that in all states). I had lost the paperwork that was given to me in court when it happened but for the interview, I obtained a copy (via e-mail) of the disposition from the Houston court and also printed my driver records from Texas and NY state (they both show no record). She asked me for a proof of the disposition and I gave her all 3 documents (the initial fine was less than $200 btw). She then said that she needed the original of the disposition and that she didn't know if what I gave her would be enough. She went on with the interview and went over the last sections of the application. At the end she told me to go back to the waiting area because she had to speak to a supervisor about the deferred disposition situation. She came back about 10 minutes later called me at the door and handed me the form saying "it's ok, you can go back home now, you will get a letter from us in the mail". I took the paper and left. For some very weird reason, it didn't cross my mind to check what was on the form or even to ask her if they were ok with the docs I provided! ha!

When I got out, I looked at the form, she checked the pass box for the English and civic test, and the box that said they will send a decision via mail. None of the "recommended" or the "can't make a decision" box was checked. So I started to be a little worried!!! I don't think they would deny me for this, but if they do ask me for an original or any further proof, I am probably in for a trip to Houston to go to court in person!

A few hours after my interview, I got a notification that my status changed to "case under supervisor review". Not sure what to make of it. Would this mean that the IO recommended for approval and it is now under supervisor review or could it mean that they are reviewing the file to make a decision on this speeding ticket issue?

I think you will be OK and that they are verifying the disposition and that it was indeed only a minor traffic offense. Hopefully, they can do so on their own or, if you do need a court original, that you can get one without having to travel to Texas.

Sometimes a case status is updated to "under supervisor review" even when recommended for approval, although they usually don't make this update... in your case, my guess is that the interviewer has passed your file on to a supervisor to decide whether to approve you or send you a Request for Evidence. Recommendation: call the Houston court now and ask if they can mail you a disposition letter. I did this with a court in Waco, TX and they said they could do it if I sent them a request in writing. There was no charge. I don't know if Houston will do this, but it's worth checking while you wait to hear from USCIS.

It's a little frustrating because USCIS instructions clearly state that you're not required to present evidence or documentation for traffic infractions that are not DUI related and that have fines under $500. But quite a few interviewers seem to ignore this and insist on evidence. Others make a note of the citation and move on. Others will cross out citations on the form and say they don't need to know about traffic tickets. Good luck.

Don't second guess your actions; you did the right thing by being honest... I think you did the right thing... I really don't know which records the interviewer has access too... I don't think they have the details of your background check, but they probably have access to those details if they want them... part of the background check is an FBI check, which will return even expunged records, unlike a less rigorous criminal check that an employer can request.

If you search through interview experiences here on VJ, you'll see that failing to disclose citations can, in some cases, cause a lot more problems. one applicant from a couple of years ago wrote that her interviewer had a high-level copy of her background check. It showed a court conviction for an offense on a certain date, but no other details. The interviewer called in a supervisor who then noticed that the date of the conviction was matched one of the citations listed on the N400. They asked for a copy (just a copy of the fine receipt) and approved the applicant on the spot. There are other cases reported here too where applicants were asked out right why they failed to list citations... but in most cases it doesn't come up.

So, in most cases, none of this even matters, but it's best to be prepared for the few cases where the interviewer decides to be a pain.

Just out of curiosity, I wonder how would USCIS handle records (citations, fine/court receipts, etc) that no longer exist?

I know most of you are naturalizing in under 10 years so it's not much of a problem, but those who wait 15 or 20+ years may never be able to produce such documents for incidents that happened well in the past. I know I recently tried to get a copy of a fine receipt from the last citation I received back in 1996 and the Clerk of the Court said they had no evidence that it ever existed because they destroy records after a certain period of time (7 or 10 years, I don't remember.) They couldn't give me proof that I had paid only that they had no record that I owed them anything at that time. Normally, no one asks for records that far back, but the N-400 is very emphatic about "Have you EVER..."

I agree. You will be okay Yanndny. In the instructions it said :

You must submit documentation of traffic incidents if:

(1) The incident involved alcohol or drugs;

(2) The incident led to an arrest; or

(3) The incident seriously injured another person.

You do not need to submit documentation for traffic fines or incidents that did not involve an arrest or did not involve drugs or alcohol, if the only penalty was a fine of less than $500 or points on your driving record.

So I think since it was disclosed, the IO could say one of the 3 must exist. Like others have said the IO was having a bad day. I am really sorry this is happening to you. I hope they get it cleared up soon.

I need help, they are asking for the last 5 years on tax returns, but of course I have all but 2011, there is no way to ask for that transcript online or by phone, I already try, do somebody have a similar problem? and how can I solve it, I don't know if I can just show up on a IRS office and ask for that copy

You can call IRS, I call them all the time when I need my transcript and they fax it to me, let them know its urgent and they will fax you a copy. Just make sure you are standing by the fax machine especially if it is a public fax machine.

Call 800-829-1040 and use the exact numbers am going to write below to talk to a live agent (depending on if those numbers fall into your category). The first question will be to press 1 for English after which you should press the following for each questions that come after that.......2, 1, 4, 2, enter social security number, confirm social security by pressing 1, another 1, then 5 and the rest few questions will lead you to a live agent.

Just out of curiosity, I wonder how would USCIS handle records (citations, fine/court receipts, etc) that no longer exist?

I know most of you are naturalizing in under 10 years so it's not much of a problem, but those who wait 15 or 20+ years may never be able to produce such documents for incidents that happened well in the past. I know I recently tried to get a copy of a fine receipt from the last citation I received back in 1996 and the Clerk of the Court said they had no evidence that it ever existed because they destroy records after a certain period of time (7 or 10 years, I don't remember.) They couldn't give me proof that I had paid only that they had no record that I owed them anything at that time. Normally, no one asks for records that far back, but the N-400 is very emphatic about "Have you EVER..."

No idea, but that's a good question that I've wondered about. I'm yet to come across a case where an applicant had an incident that was that old and where the interviewer wanted to see evidence... in most cases the applicant is able to present something after a bit of effort. But you're right, that for those who have been here for 20 or 25 years, it may be impossible to obtain a disposition.

I read about a similar case (not immigration related) on another forum... someone was trying to get a security clearance for an airline-related job and his background check showed an incident that was 25 years old (it was relatively minor; something like ignoring a traffic citation and having a warrant issued, which was then dropped when he paid the citation and court fees). But this guy spent months trying to get any sort of documentation related to this, and couldn't find anything. I don't know what one should do in that situation.
