can my husband apply for citizenship now?

Hey guys,

My husband sent his ROC paperwork on May 2015 and his case has not been approved as of today. We are still waiting and his one-year extension letter expires in July. We have been married for over three years now. My question is: is he a candidate for applying for citizenship?- if so, can he apply even though his ROC still pending?-

what's the date on his green card, that 'resident since' date ?

He can apply 90 days before his third anniversary of being a permanent resident. According to your timeline, he received his card in July 2013, so that would put him into April 2016 (three years of residency minus 90 days). You do the exact math.

Yes, he can apply even if ROC is still pending.

Yes, he can apply for naturalization (assuming he is still married to the US citizen) when he gets to 90 days before he's been a permanent resident for 3 years, which in his case should be 4/30/2016.
