Hi--I just wanted to let others know that I went to talk to a man who does international taxes. He told me it is not so easy to get an ITIN number. He said it would be better to file married filing separately this year. But the weird thing is that he said there is some new law about not being able to go back and amend the filing for 2015. Does anybody else know what he is talking about? I'm sure we would get much more tax back if we filed jointly, but I was going to wait and amend when he gets here. I wish this stuff was easier!

If you file jointly based off what I have read you will also pay taxes on what your spouse also made. So that income depending the spouses's country made be paying taxes twice. Their and USA.

I was going to file jointly with my husband until I find the details of needing all his income for the year when he is already paying taxes.

As for amendments, I'm unsure but less contact with the IRS is something I prefer. Even though we might have gotten more back, the frustration just isn't worth it when we are already stressed enough with immigration.

Ha. What new law that says a person can't amend a prior tax return? Stupid. Just plain stupid. Does anybody else know what he is talking about? No because he is full of . How are you going to amend when the man you talked to said that there is a new law that will not allow you to be able to amend? I wish this stuff was easier!

Is this man an accountant? If he is, then he sucks. If he is not, then he should not give out tax advice.

Get your tax advice from a qualified accountant. It's cheap. $200-$400.

Don't take any more tax advice (or any other advice) from this man. He is full of . New law preventing amending a tax return. What a load of #######.

if you want to file M-F-J, chase an ITIN, including IRS Form W-7, and send it all in, a paper return, to the Special IRS ITIN Intake office address in Austin, TX.

sure, it's a paper return, but so what ?

If you file jointly based off what I have read you will also pay taxes on what your spouse also made. So that income depending the spouses's country made be paying taxes twice. Their and USA. Wrong. There is no double taxation. The US gives a US tax credit for foreign taxes paid.

I was going to file jointly with my husband until I find the details of needing all his income for the year when he is already paying taxes.

As for amendments, I'm unsure but less contact with the IRS is something I prefer. Even though we might have gotten more back, the frustration just isn't worth it when we are already stressed enough with immigration. Electing to be a US taxpayer is easy when the foreign spouse has little or no income. It's a no brainer if the foreign spouse made a ton of money in a country with a lower tax rate than the US; don't make the election to be a US taxpayer. For those in the middle, it's having to do the tax returns both ways (MFS or MFJ) to see which is the better result. The difference can be several thousands of dollars.

It is not so difficult to get an ITEN. If your husband lives near ISB, have him go to the embassy along with the ITEN application form and his passport. They will notarize it for you and then you turn in that paper along with a signed statement that you want him to be treated as a resident alien for tax purposes.

That is what I did, let me know if you have any questions about the process

He was listed under the official IRS site as a qualified person. I guess I'll just have to figure all this sh% by myself. I hate all this #######! grrrrrr

H & R Block in Knoxville, TN

H&R Block is not the IRS.

The IRS is part of the US Government. H&R Block has nothing to do with the US Government.

H&R Block is a private business that has two sides; 1) filing tax returns during the tax season, and 2) running a tuition based educational program for those who want to be tax preparers with minimal education in a few months with the hope of employment with H&R Block during the tax season.

I have a graduate degree in taxation. I strongly advise going to H&R Block because the staff is poorly educated about tax issues.

This man is a moron and should not be giving out tax advice.

Note that the US also provides for a foreign earned income exclusion as an alternative to claiming a foreign tax credit. This allows for the complete exclusion from taxable for foreign earned income (eg salary) up to a limit of somewhere around USD 120K to USD 150K.
