filing I-864 without tax records but with sponsors

I'm really hoping someone can help. During step 2 of the I-130 process, you need to file the I-864 with tax returns. I've been living in Argentina for 8 years, but 3 as an official resident as Argentina doesn't have strong immigration laws. During that time, I have been working, but part-time as a self-employed English teacher; Therefore, I haven't filed taxes the entire time I've lived here. Will this affect step 2 of the process? Should I include my employment information on the G-325a or put that I have been unemployed. I don't want to lie, but I don't want to be denied because of the omission of tax forms. I do have a sponsor for the I-864 and even a second sponsor if need be. Will that be sufficient to be approved in the second step? I would greatly appreciate the help!

Yes since you are a US citizen, and US citizens are taxed on worldwide income. You were required to file US tax returns on your foreign income. You will unlikely owe anything, but you still have to file. Should I include my employment information on the G-325a or put that I have been unemployed. Dont' lie. Once you are caught as a liar, do you think they will believe anything else you have to say or the documents you submit? Why would you even consider lying? I don't want to lie, but I don't want to be denied because of the omission of tax forms. I do have a sponsor for the I-864 and even a second sponsor if need be. Hi,

Be a big boy and file your US tax returns as required. Lie and screw with the US government, and you will pay the consequences. Don't come crying when she doesn't get a visa because you lied.

Best of luck

I don't want to lie, but it's sure I won't need to pay anything. I didn't intentionally not file; I didn't realize that I had to as I haven't been working officially or making enough money to owe anything. How am I supposed to file taxes for 8 years with no records? I don't want to screw with the government, but I don't want to have the process interrupted or denied on a technicality.

You need to file for the last 3 years for the Affidavit of Support.

Why don't you have records? Ask your employers. It's your responsibility to have and keep these records. Ignorance of the law is not an excuse, so it doesn't matter if it's intentional or not.

It's not a technicality if you fail to file your US tax returns. It's not meeting the requirements for the I-864, thus no visa. It's a requirement, not a technicality.

I'm not sure your information is correct regarding this. As I mentioned, I have no employer and I work as an English tutor in my home thus no papers. Can I please get an opinion from someone else?

Guess my graduate level tax degree is not good enough to qualify me to answer your question.

Essentially, you worked illegally under the table. Even Al Capone was required to report his illegal income.

File your US tax returns with your illegal income or not. It's unlikely that the US Embassy will find out about it.

Regarding taxes, I imagine you're right, but as they're distinct departments whether or not I'm following tax law isn't immigration's main concern. I just need to know if my sponsors will be sufficient, if I do not have those documents. If I do need to back file my taxes, I will do so, but as I said, I am not in the system anywhere. I could just as easily be a homemaker. Do I have to file as a homemaker?

No one here is going to help you lie. No one here is going to tell you to file as a homemaker. Why do you still consider lying?

You are violating the terms of use on VJ by continuing to ask if it's okay for you to lie . . . like being a homemaker.
