Hi all.

We filed for AOS, AP and EAD on November 4th. (adjusting from K1)

Got the NOA's within 10 days of applying....since then, nothing.

Just thought I'd share and see if others are within a similar time frame?

I see from the processing times that USCIS should be dealing with submissions around the time we filed so I am hopeful I'll hear something soon. The USCIS website 'case status' hasn't changed in weeks :clock:

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi,

We filled our AOS and EAD on the 3rd, and got the NOA's for the 5th.

Have you had the appointment through for your biometrics yet?

I had my biometrics done on the 25th November, and my EAD was approved yesterday.

I would suggest ringing USCIS and asking them to open an inquiry into your case, as you are now over 75 days (if they argue about the 3 month timeline, just keep telling them their website clearly shows you can submit an inquiry after 75 days). If they still say they can't, ask to speak to someone who can.

I'm not saying it had any effect on me getting approval, but hey, it can't hurt, right?

I know exactly how you feel, I was checking my status daily!!

It really depends how busy your local uscis office is. Sadly, it's not unusual to wait for months. You have several options:

1. Call USCIS tier 2, inquire if they've sent you a notice for biometrics or not since you've been waiting x number of months now

2. If your local uscis office is near, maybe pay them a visit w/ infopass appointment

3. Just wait till you get your letter, maybe it will come in a couple of days/weeks/maybe more (i know it sucks...)

Has no effect on speed. Yeah, would've been wise to apply for AP with your AOS since it would've been free anyway and AP is good to have on hand just in case.

My wife is impatiently waiting for her approval. We filed November 6th 2015 and had biometrics December 8th and still nothing. We are nearing the 75 day point and I think we might call on day 76 if we don't receive anything. Norm and Nella, we live in Las Vegas as well.

An update... I just called USCIS and spoke to a very nice lady who told me my only option was to open a Service Request and someone will be in touch in 15-30 days (I hope I hear something via the normal channel by then)

Next you will hear is about your EAD/AP which should have an update or be completed around February. For the AOS, I also filed a service request back then but didn't really help. There will indeed be a long silence for AOS. In my case, after receiving the potential interview waiver, everything went silent for 6 months. They are so backed up that my case wasn't even adjudicated in North Carolina. They had to send it out to another USCIS office. Good thing about this though is once this part is over, you can rest for 1 year and 9 months until ROC! :joy:

Well... I'm getting pissed off... the notice that the USCIS sent me a week ago got sent back to them by the Post Office, according to them "it could not be delivered", so now I'm stuck waiting......... (only GOD knows how long) for them to get my request for a copy done.

I was going to do this online but I couldn't do it since I have NO idea what kind of notice it is. I already got my NOA1 and a pink piece of paper letting me know they need more evidence for my form I-485.

When I called them yesterday they gave me a ref # starting with T1F... I just checked my status and it still says "Notice was returned to USCIS because the Post Office could not deliver it" - I'm getting impatient....

Less than 24 hours after logging a Service Request for my EAD and AP - I checked my status and they have been approved!! Not sure if it's a coincidence, but I'm very pleased. Certainly worth calling as soon as the 75 days is up!!

Just wanted to add what happened with my EAD card in case this happens to you (bit of a long story, sorry in advance!).......

So we live in a large gated complex, where post is delivered to the main office.

We all have our own little post boxes, and anything large or that needs to be signed for is left with reception (Open from 9am to 6pm)

So yesterday (Wednesday 27th Jan) morning, I wake up and check my phone for any texts/emails I may have and there it is, the one we all we dread to see...

"On January 26, 2016, the Post Office determined your card for Receipt Number MSC####, is undeliverable. We mailed the card to the address you gave us, but the Post Office could not deliver it. Blah blah blah etc etc"

Obviously my heart dropped and I felt sick in my stomach. I checked the USPS tracking information, apparently, it came into the local post office at 4pm, and they decided it was not deliverable at 6:35pm and would be returned to the sender :(

I thought they must be wanting someone to physically be there for the letter, and with the office being shut that was it Game Over.

My wife suggested we go to the Post Office, and see if they still had it, which we did.

The very, very kind lady there took the tracking number and went and checked the whole cage of mail that was waiting to be returned but she couldn't find it.

She said that she was sorry, but obviously couldn't check the carrier's whole van. She said they might redeliver that day and also to double check with the main office at my complex.

On the off chance that it might do some good, I requested redelivery of the package for the 28th, and then called USPS to try and track the letter down. They had crazy wait times (like 2-3 hours) so I left my number for a call back.

When they called back, the woman confirmed she could see the re-delivery request was there (their website took a long time to update from Returning to Sender to Redeliver Requested), and that there was nothing on the computer to say the letter had been returned to sender yet, so best she could figure is that it would be re-delivered either that day or the next.

I waited patiently (yeah right!) for the mail to be delivered to the main office. Soon as I saw the van park up, I ran to the office to see if she had the letter.

The post woman apologised, as the day before had been her day off, and she would never mark it as undeliverable, even if an apartment number is missing, she would leave with the office for them to track the person down. She said she would check with the woman that delivered the mail the day before and see if she remembered what she did with it (she even knew what I was talking about, because of my trip to the post office that morning!!)

She checked all the packages she had that were marked priority, and apologised for not being able to find it, but promised again to try and hunt it down and bring it the next day.

I headed back to the apartment, hopeful that the card would be found and delivered the next day.

As I'm sat there trying to stay positive, I get a text through to my phone, that the letter has been delivered!!!!

I flew down to the main office, and the post lady was waiting for me, with the letter in her hand.

I'm never been so excited to see a piece of mail!!!! She said she's no idea why they didn't deliver it the day before or what they were doing.

So, the moral? Never give up hope!

  • Sign up on the USCIS website for an account and get a login.
  • Type in your case numbers, and set them to Text and E-mail alert.
  • As soon as you get a text saying they couldn't deliver, go onto USPS website and request re-delivery.
  • Ring USPS straight after (if they are open), and double check with them if they can see the re-delivery request or whether the letter has actually been sent back.
  • Go to local Post Office, and ask them to check (this depends greatly on how nice the post office is where you live I guess. Mine seem really really good!)
  • If you can catch post woman/man when they deliver the next day, speak to them, and ask them if they remember trying to deliver it.
