Boyfriend/Fiance visiting with for 5 weeks.. worried about proving intent to return

Hi,

My boyfriend and I are planning to apply for the K1 and he is coming to visit me for 5 weeks on an ESTA to meet my family. We thought now was the perfect time since he is between jobs so he has the time for a long visit. It will be his first time visiting the US and I'm a little worried about proving intent to return. We have his car registration, car insurance, bills from his bank about monthly payments he has to make, and his return ticket. The problem is that he cannot prove sufficient funds. I paid for the ticket and ESTA, and he will be staying with me for the whole trip.

I know he will be at the mercy of the CBP officer he gets, but what are the odds of closer scrutiny with such a short (relatively) visit? Thanks!

(Beneficiary also received I-134 packet). Packet 3 checklist available through state department website.
July 20th, 2016 - Packet 3 received from Frankfurt consulate
July 27th, 2016 - Packet 3 sent to Frankfurt consulate with regular mail
August 3rd, 2016 - Email notification to schedule interview
August 8th, 2016 - Medical interview in Munich
August 22nd, 2016 - Interview.... APPROVED!
September 10th, 2016 - POE at LAX
December 6th, 2016 - MARRIED!

April 24th, 2017 - Received second rejection notice for AP
April 28th, 2017 - AOS Interview Scheduled

all those things you listed are NOT ties to his country....bills can be paid from overseas, an near empty bank account can be emptied further and insurance is...well, insurance. He might sail right on through, but a few questions from a probing CPB officer and he might be sent home. CPB officers can sniff out weakness or fear (the good ones) and might easily pick him out of the arriving crowd for further questioning. I've worked side by side a couple of times with CPB - it was very educational....good ones scan the arriving crowd and start zeroing in on those who merit further scrutiny, with remarkable accuracy. Evasive non-answers could mean a trip to 'secondary' (a separate interview process, behind closed doors, that can be intense)....so if he or you are thinking about 'creative' answers to probing questions, well, tell him to bring a good book to read for the abrupt return trip home.

nope. why? last 2 years, many ethnic pakistani males holding uk passports were coming into the usa on vwp, and got married, and have never left. This skews the numbers, and CBP is doing more scrutiny at the POEs.

personally, I hope they continue to be more than vigilant, for so many reasons. If you, as an arriving alien are legit, welcome; if you are a scam artist, adios.

If he tells the truth and is honest that he is there only for a visit is it still a problem ??? I have read in this forum that many people have successfully been able to visit by just being honest and truthful...

anything is possible...but that will depend on how focused the CBP officer is, and what sort of reaction the BF gives when asked about his proposed visit....what is he going to say, for ex, if the CPB folks ask, 'how is it you can take 5 weeks off of work?'....and he blurts out, 'I'm between jobs'...hmmm...or stammers out a lie....then what?

According to the OP, he has yet to visit the US. We don't know what CPB might ask him - sometimes (like a CO), they ask innocent sounding questions as a prelude to a more pointed question.....to try and gauge the applicant's credibility quickly....he may well skate through without a hitch.....unless, when asked who he plans to visit, he chokes up...'my fia.....er....a.....a.....a.......friend!'....

He's not nervous about answering the questions so I don't think he'll accidentally say fiance. But since I paid for the flight and ESTA, now we're thinking honesty might be best and he'll just say he's visiting his girlfriend.
