My spouse (soon to be ex-spouse) took my daughter to US without my consent. They are now permanent residents (green card holders). I so much want to see my daughter since it's been 2 years. I applied for a tourist visa but got denied even after telling the consul about my situation. The consul told that I have too many relatives in US (I also informed him that I have 2 sisters there).

I am planning to apply again but what can I use / say to get my visa approved. I honestly do not want to live in US and that's one reason exactly why I haven't been to US, else my wife could have petitioned me and I can easily be in US.

Kindly advise me what to say or how to justify my case next time I get an interview again.

You would have to show strong ties to home such as property or financial assets, good job or business, immediate family members.

Coming from PI you will have a difficult time securing a visa with many close family members living in the US. Focus on showing your reasons to return home, not reasons for staying in the US.

The COs do not care why one wants to GO to the US (unless the applicant told them they wanted to rob banks or something!); they are only interested in why one would LEAVE the US...I could easily imagine that an applicant would use this excuse, however valid, to remain in the US....why? Because even if you were granted a tourist visa, how are you going to locate the soon-to-be ex-spouse and child? They could be anywhere....and traveling around the US in a vain search will be expensive (and no, the CO will not ever believe that your 9 month search will be paid for by friends), requiring you to start looking for work to pay for it all....and even if you miraculously located them, what then? You cannot force your wife to hand over the child, or even allow a visit...she might call the police on you, claiming who knows what. Who has custody?

But hoping that a CO will ignore the tears and hand over a visa is a pipedream.

This is correct, if she took them withour your consent, you need to get the authorities involved.

I agree wholeheartedly with this. Do you have sole or joint custody or maybe no custody at all? The latter would be a major problem for you.

Not sure about the Philippines, in many countries, even if the other parent has full custody, that can't leave the country without the other parents permission.

You have to seek legal advice on this issue.

Now, even if I mention it (unsolicitedly) in my next interview and IF I lie about my wife and daughter being in US, will that be fine? Will they find out? What's the consequence? I do not know where they are, anyway, except that they're in US. I just think that I will have a stronger reason to not stay in US if I project that my wife and daughter are here in Philippines. What do you think?

Never lie to the US Government for a visa.

Why would you ask Americans how to lie to get into the US?

Do not ask for help doing illegal things like lie for a visa.

Your previous application and interview notes will be available to the interviewing officer.

Your business circumstances changing all of a sudden PLUS adding an obvious lie about your family in the US will get you denied in about 10 seconds and destroy any credibility you might have had in the future. Your file will have a big red stamp on it saying CANNOT BE TRUSTED.

Always remember that everything you've said in past applications will be in their system forever.

At my last B-2 interview the officer brought up things I'd said in my previous interview 10 years earlier.

NEVER lie to them.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Once again, if you try to be more clever than a CO, bad things will happen....when an applicant makes a blatant lie (as opposed to merely trying hard to conceal something), the refusal notes will contain terms that brand that person as untrustworthy, even if that person is not denied (more seriously) for misrep and fraud....which will mean there will be nothing you could say for years that will even come close to getting a CO to believe a single word you might ever say in a future application. In busy embassies like Manila, there is little time to hold the applicant's hand for 20 minutes and try to soothingly get to the real story....your name and character will bubble up to the screen, and your next interview might last 45 seconds.
