I'm a US citizen, she's in the Philippines.

We'd like to get married in the Philippines before the K1 Visa process is approved. Is this possible, or would it make the process more difficult?

Also, can we marry in the Philippines after the K1 visa is approved also? So she'll be traveling to the US with a K1 Visa and we'll have a civil wedding in the States.

You cannot get married in the Philippines while processing K1 or after getting K1 visa and enter US with a K1 after getting married here.

K1 is a fiance/e visa that allows your partner to enter US and get married within 90 days. If you wanted to get married in the Philippines, you may do so but you cannot apply for K1 after getting married. You should petition her as IR1/CR1 as your spouse.

Entering with a K1 visa and married is in violation of US immigration laws.

Marriage would void your K-1 visa (if granted) and cause you to have to file an I-130 for a CR-1 visa.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Married is married.

You can throw a big party and stand up in front of everyone and profess your love for one another. But don't have an officiant who is able to legally marry anyone.

K-1 is a fiancee visa for marrying in the USA. If you plan to marry in the Philippines pursue the spousal visa, CR/IR-1 visa.

My fiance has had to talk me off of the "let's just do it!" ledge several times. I know what you guys are going through. At this moment, we're waiting for him to get an interview letter. CEAC status says READY but it's anyone's guess. So, on Sunday, I just withdrew money from the wedding fund and booked a flight to London for next month. I cannot go more than 4 months without seeing him. At this point, we will be doing JOP. LOL

What is "JOP" ?? Just Our Part?

Justice of the Peace, basically anyone legally authorized as an officiant in a wedding ceremony that isn't a member of the clergy (priest, pastor, minister, etc). It's a catch-all term for a non-church wedding. :)

06/12/15 - Met online and started talking
09/25/15 - She came to the US on holidays, decided to spend a weekend to meet me in Texas.
10/02/15 - I must have done something right, since she came back the next weekend too! :whistle:

10/05/15 - Sadly, she had to return to China for work. We keep talking.
11/12/15 - I leave to visit her in Shanghai. A very beautiful city, if I do say so myself.

11/16/15 - My turn to leave for work. :(

12/10/15 - I-129F sent to USCIS lockbox.

12/16/15 - NOA1 email received.

12/21/15 - NOA1 hardcopy received.

01/21/16 - NOA2 email & text received. 36 days processing time!

01/25/16 - NOA2 hardcopy received.

02/03/16 - NVC received (date uncertain?)/GUZ # assigned

02/04/16 - Sent to Guangzhou embassy

02/07/16 - She's come to visit for CNY :dancing:

02/20/16 - Our holidays together are over *sigh*. Back to waiting...

03/11/16 - Packet 3 received.

03/13/16 - Packet 3 returned.

03/18/16 - Packet 4 received.

04/21/16 - Interview at GZ - Approved! :luv:

04/23/16 - I have to return to work...back to waiting for her visa to arrive.

As others have already stated, the K1 cannot be used if you are already married. You can get married I the Philippines and file for a spousal visa (CR1/IR1), or you can go the K1 route and get married in the US after she arrives. If you want to have a celebration with the family in the Philippines, I would suggest having a party before you leave, but no marriage, or going back after the US wedding with the AP or GC and have a party then.

The point is you have many options, but one of them is not a K1 when you are already married.

So you're almost at the finish line and now you're just going to throw that away and go to London, get married and start over with a spousal visa and wait another year? Why??? You say you can't be away from him for longer than 4 months and now when you're almost there you're going to be away for a year?

No, I am not getting married but I am going to go and see him. British Airways had a sale on flights so I bought one. I have not seen him since October.

I mentioned Justice of the Peace as a joke.
