Hello, I'd appreciate any insight and expertise you have on the questions below. I sponsored my partner for a Green Card and we've had some major life changes that are making us consider moving out of the country to be closer to family.


1) If a person has gained US Permanent Residency but then loses status by leaving the US for a few years, is it possible to reapply for the Green Card in the future? Is there a "cooldown" period of any kind?

2) If it is not possible to reapply after losing US Permanent Residency, is there a different way to return to the US to stay long-term?

1. yes. i assume you two are married in the usa, so file a I-130, chasing a spousal visa.

2. Sure ! EB-5 visa. Works every time, and there's no cap or limit.

1. I do not think that is correct, if you lose your permanent resident status, you cannot "get it back" a few years later. You would need to find other ways to get a green card (Lottery etc...). I may be wrong but I don't think so, that would be too easy... OP I suggest you think twice before surrendering your green card, especially if you think you might want to come back later (Check http://www.uscis.gov/green-card/after-green-card-granted/maintaining-permanent-residence )

2. Visa EB-5 is not available to anyone who choses lol. You need some serious financial assets (Just check USCIS: http://www.uscis.gov/eb-5 ) And basically need a solid business plan.

I guess you are saying that OP is an american citizen. That was not clear.. If so then yes you can re-apply for LPR, sorry!

eh - not saying it - but yes, that was my assumption - petitioner is a USCitizen.

Perhaps he/she will come back and tell us more ? More is always a good thing.
