DCF London Residency Requirement

Hi guys - my fiancé has permanent residency permit for the UK. For the past couple of semesters he has been working for a US university on a contract basis, traveling back to UK in the holidays. We plan to submit DCF and are wondering if there will be an issue with the residency requirement, even though we have a joint rental lease, bills etc to show that we have been living together in UK for 10 years? Any advice would be appreciated.

Nope. There's no minimum residency time requirement anymore - you just need to be in the UK as a legal resident of some kind for any length of time (used to be 6 months). See a link to the guide in my signature for more.

If his residency is no longer the UK, however, and he now declares himself resident in the USA again, he can't file DCF.

Yea, they would need to get married if they want to file DCF, and then petition for a spousal visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No, I assumed they were planning to marry and file I-130 for CR-1.
