Thank you very much for all your help VJ members. I am enjoying the Colorado weather now, lol! Anyway, I'd like to know if I MUST have my social security # first to be able to apply for adjustment of status? I have applied for SS# already, it's just that it has not arrived yet. But im hoping to get it here soon. I want to apply for my adjustment of status anytime now but I wanna be sure if Social # will be needed.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The instructions for the I-495 does not state that a ss# is required to complete the filing of the AOS. I recommend reading those instructions and those of the other forms for a better understanding of the requirements when submitting the complete AOS documents.

The SSN is not required to file the AOS, but if you have the ability to get it, I would (I.e. More than two weeks validity on your I94). Many banks require it to open bank accounts, and many states require it to get a driver's license.

Thanks!!! I have another concern though. I did not know that I must file AOS 2 weeks after my I-94 is valid (at the latest). My I-94 was only valid Dec 19, 2015, and I will only be applying AOS this January. Am I in trouble? :-(

You misread that poster's comment. In order to get a SSN based on a K-1 visa, the I-94 must have at least 2 weeks validity before the SSA will issue you a SSN. You can file the AOS at anytime. The only requirement you have as a K-1 visa holder is to get married before the I-94 expires. One you do that you have fulfilled the requirements of the K-1 visa. The sooner you file the I-485 (and the I-131 and I-765 for travel (Advance parole--AP) and working (employment authorization document--EAD) while waiting for the green card (GC) the sooner you can begin your life in the US.

Dave is right. Your late for the filing of your documents but, you can still file the AOS but will have to wait till you get your GC to visit SS to get your SSN.

Two weeks after you arrived in the US you should have gone to SS with your documents and a copy of your I-94. Then get married within the 90 days of arrival to satisfy the K-1. Then file your AOS and once you received your GC then go back to the SS office and have your name changed (to married name) and also to get the restrictions removed.

I apologize for creating confusion. As was already stated I was referring to applying for a SSN, not for filing the AOS package. As long as you married within the 90 days you are fine. There is no time limit to file the AOS, but it seems you missed the window for applying for a SSN. Once you file the AOS and assuming you also apply for the EAD/AP, you can apply for a SSN once you receive the EAD card. The SSA will not allow you to file sooner since technically you are out-of-status until USCIS updates it with the EAD/AP or GC.

whoa - who made up this monkey snot and passed it on to you ? There is no rule or law about when to file for AOS, when holding a K-1 visa.

Seriously - find that person and duct-tape their hands and feet together, toss them from a moving car at high speed ! They are giving you detrimental info !

everyone? oh, I hope not !

Things shifted after electronic I-94s, the SAVE DB was updated instantly, same day as POE, so a K-1 visa chaser could go into SSA office the day after a POE event, be found in the SAVE DB, and successfully apply for (and get) a SSN.

It used to be 2 weeks, because of back-room ops at the POE, humans dissecting the 'do not open' visa packet that you hand carried in.

Now it's next day, due to some automation and bar code scanning.
