I am in need of help! I have a friend that has a very usually case and unsure which direction to go. He has three children two daughter 21 and 15 and one son that is 18. About 9 months ago their mom pass away from an illness and he is here in the USA and they are still in Jamaica. He would like to know if he is able to file for them to come to the United States also.Thank you in advance.

hi

as said, he will file one i130 for each of them, he should file immediately for the 18 year old to not go over 21, since the petition will take around 2 years

for the oldest daughter, she must remain unmarried at all time, the petition will take over 7 years, and the child will come with her as her derivative

Hi,

Follow the Guides.

If he files today, the 21 years old will be in the F2b category where it's 7 years for a visa. The 2 years old will be able to immigrate with mom. Mom must remain single.

If he files today, the 18 years old and 15 years old will be in the F2a category where it's about 18 months for visas. They must remain single.

Best of luck

From a practical point of view there are 4 of them and one of him, more logcal for him to move?

Yes what you see as logical maybe a great idea but, living in a third word country with limited income opportunities there he believes this is best. Are you moving to your fiance's country?
