Help! Domicile Issues - U.S citizen born abroad

I am a U.S Citizen born abroad in Denmark, and have lived here my entire life.

In October 2015, our i-130 was approved, and sent to the NVC.
Now it is time for us to prepare the CR1, and the affidavit of support.

Luckily i have a family member in the US who are willing to become joint sponsor, and who meets the financial requirements to do so.

BUT!
I am starting to sweat a little over the fact that i have no proof of a domicile in the US, since i have never actually lived there. No school or employment records, no housing, no medical records or tax returns.
The only things i have that ties me to the US is my passport and my registration of a child abroad.

I know that there are some exceptions, if you can prove that you are intending to reestablish your domicile, but how?


Any suggestions, tips or former experiences are most appreciated.

If you have a join sponsor, you don't need proof of a domicile etc.

My wife and i, are moving to the US and we don't have domicile in the stats.

and so fare we´re all the way to almost end of NVC.

You WILL need to prove that you intend to re-establish domicile. Some things you might do:
- You mentioned a child; enroll them in school or look for daycare

- Sign on with some job agencies to look for jobs.

- Where do you plan to live? Proof you have something sorted out; buy a home, sign a lease, or get a letter from a friend or relative where you will be staying.

- Take a vacation to visit the area where you intend to live. Take the time to register as a voter, get a US drivers license, and make contact with local possible employers. Maybe even get a US cell phone or something with a bill.

Yes you very much have to prove domicile if you are the USC at the interview. NVC could careless.

Please note, if the petitioner lives with the beneficiary abroad, you'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. • Lease agreement for our house

• Email from schools regarding registration requirements

• Email from my former auto insurance company regarding my inquiry

• Email from XXXX with estimate and correspondence regarding shipping our belongings

I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of spouse's admission into the US.

I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.

Well i was wrong, looking back at last time i was moving to US.

All my wife had was Drivers license and maybe some Tax returns.

If you have been earning $10,000 or more in any of the past 3 years (the affidavit of support asks about the 3 most recent tax years) you will need to have filed a US tax return. This needs to be sorted out to avoid any delays. The US taxes on worldwide income. There are treaties to make sure people are not double taxed. However, that does not exempt you from filing a tax return.
