When I met my now husband I had NO idea what we were looking at just to be together. I am a US Citizen and have been a big advocate of LEGAL IMMIGRATION. So there was never a question as to us having him immigrated to the US from Canada.

I went to a lawyer and really didn't see why I couldn't do this myself. I submitted the I-130 with all the supporting documents. That was approved and our case went to NVC. I received the packet from NVC and started going through this list of items. Here is my confusion. First it asks to pick an agent it I so choose. I chose myself as I am the Petitioner and know all of the info requested. But as I am filling this out it almost seems as if the questions are directed at my husband or, applicant. But it was sent to me?

I am at a point in the form where it asks for the immigrants photo for a passport. We submitted 2 photos each for passports when we submitted the I-130. Being that my husband lives in Canada do I have him get MORE passport photos and send them to me so I can submit them with this package? It seems like many of the documents that were submitted with the I-130 are being requested again with this application.

Then I see on the list that is wants police and prison records? Neither of us have any. Do they want this from us both or just him? if so then why did I get this paperwork?

Last item is on this cover letter it says Once they get all the info his interview will be scheduled in Montreal, Canada. Well he moved from Alberta to Vancouver so Montreal is a LONG ways away. Yes I submitted a change of address when he moved. I also followed up with an email to confirm they have his correct address. Have heard nothing.

Thanks if anyone is able to clarify any of this for me.

The mail is directed to your husband but since you chose to be an agent, that's why you received the mail. The mail will tell you to submit the beneficiary's documents (or your husband's documents).

Spousal visas ONLY go through Montreal. Sorry, you'll have to add the travel costs to your fund.

The police records...he'll need an RCMP check to send in. He can take care of that at any police station but it has to be a federal check, not a provincial one.

Since you are at the NVC stage most of the info will be about the beneficiary (with the exception of the I864) so most people list the agent as the US citizen or the beneficiary.

Come on over to the Canada forum, I think most of your questions will now be Canada specific

good luck

Maybe I didnt word this the right way, but I got the letter in the mail on the 15th. I am the petitioner, and it was addressed to me. It said to complete these 6 steps below to begin you NVC processing.

step 1 is choose an agent. After reading exactly what the agents roll was, and it did say it was ok to be the petitioner I chose myself. I am a US Citizen, my husband is Canadian and he will be coming here to the states.

So I was chosen as the agent until yesterday. But it all of this info is related to him that makes a little more sense. Except on the Document Cover Sheet it asks for IRS returns and transcripts. Obviously that is for me and not him, as well as Court and Prison records?

I would rather be hated for who I am, than loved for who I am not ...

Its a bit double everything you sent to the uscis have to be re send to the nvc the uscis only send the approval to the nvc NOT tne submitted documents.

second of all nvc does not need photo's just a copy of the passport is fine.

further if u read on the summary page in ceac.state.gov you see that the ds260 has to be filled by the partitioner and the ds261 by the applicant. The applicant sends the supported documents with the cover letter that he got in the mail back to the nvc, and the partitioner sends the aos to the nvc.

The applicant can file the ds 261 online but still needs to mail the nvc the supported documents because uscis does not forward the documents to the nvc.

If u have sended on eccidant the originals dont worry, just ask the official documents back from the nvc with form G 884 request return of documents.

The requested prison and police reports are for the applicant he or she needs to ask his government for a certivicate of conduct and if he or she has a criminal record even if it is for stealing a candy in the candy store.

just ask the right papers for this.

he or she needs to add this in his pack of supporting documents and send this off to the nvc.

Greetzz rob

Thank everyone for all the input. Maybe its just me because this is the only time I have ever done this. All this advice is great if I knew what you were all talkiing about. I mean sure I get most of it but my anxiety is through the roof. I will go through this list of stuff again and see what it is I think is for me and just send him all the rest.

Im still waiting for my IRS Transcript, I have my last 3 years of income tax returns, my employment verification then I guess I send that to him or NVC? Oh well never mind I'm sure it will tell me in all of this somewhere.

Again thanks

Hi zuzie, what i did is sending my birth cert., certificate of conduct, marriage papers and copy of my passport completed with the translations behind it together with the cover letter to the nvc my husband in the usa sended from his part the irs papers with the aos coversheet in seperate. His came in on dec 3 and mine from out of the netherlands came in on dec 9.

itlooks like our case is now completed so... its nlt that hard just read Ll the stuff and make sure you have everything worked out a d ready.

Lay all the paperwork out in front of you and decide what is inportant for them to know and have according to the list of documents they need. Copy the whole pack 3 times

1 original documents for your self one pack for the nvc and one for the interview and every time you see something new print it 3 times and fill up the maps this way you are well prepared and its easy to send stuff out when they ask for it. As the part of the applicant for the partitioner its even easier make sure you have the irs reports and send those in.twice one to the uscis jn the first beginning and second time to the nvc for reviewing.

I hope this will help you on the way.

April 17 2015 send I-130

April 22 2015 recieved I-130 vermont

april 28 2015 noa 1 in the mail

September 21 2015 transffered from vermont to california

October 05 2015 I-130 approved at california

october 09 2015 noa 2 in the mail

October 21 2015 case recieved at nvc

December 9 2015 all mail at nvc

January 16 2016 case completed at nvc

I am going through a similar situation: I am the US petitioner and my wife is the Canadian beneficiary. We're at the NVC stage as well, and even though she lives in British Columbia her interview will eventually be at the Montreal embassy. I've found this Canada forum is helpful: http://www.visajourney.com/forums/forum/93-canada/

One benefit of going through the Montreal embassy is that you have the option to file all of your documents by email through electronic processing (EP), instead of in paper through regular mail. Your husband WILL need to bring the originals of everything you've emailed to the interview in Montreal. Make sure you get an original birth certificate (his), divorce decree from any prior marriage (his), and your marriage certificate.

For the police record for Canadians, he needs to go to the local RCMP office and request a POLICE IDENTIFICATION CHECK. As long as he doesn't have any criminal convictions, he won't need to be fingerprinted and get a whole criminal history check. Since he's lived in different provinces, his local RCMP will have to contact each province and received their results, so it may take a few weeks (usually single province checks can be done the same day or within a few days). It's important that his certificate states that they checked CPIC or a national database.

For the passport photos, since you have the option to file electronically, have him go to London Drugs or Walmart and have him take new ones and then he can scan and email the images to you, which you can then attach to his IV package. Keep in mind, he'll also need three (3) photos for his medical interview, so have him order 6 photos now (2 for NVC, 3 for med interview).

For you, tax transcripts are the preferred proof of income. You'll also need a current employer letter, and several months of prior pay stubs are also a good idea.

Hope this helps, and good luck!
