Hi guys,

I have a question regarding my upcoming trip to the USA in March.

On my last trip to visit my girlfriend (now fiance), I had to head to the USA on an emergency, she was very ill and so I flew out on October 10th intending to stay 1 week and a bit until October 21st, which I told US immigration and got in without a problem. I already had another trip booked (this was before the emergency) From November 11th to December 2nd and had sorted out all my affairs so this could happen. I decided, it was not worth returning home and so cancelled both flights and returned home to the U.K. without a problem on December 6th. Staying a total of 7 weeks.

Will this be an issue? Do they even record when you say you'll leave and when you leave? As long as it is within the legal parameters and you have proof of a need to return? ( I am a university student )

Check your passport for the entry stamp, it should have a date stamped as well. This is how long you are admitted. Leave before that date and you are fine. Or better, look up your I-94 online. That will give you the date as well.

Most of the time ESTA/waivers are automatically admitted for 90 days

and Tourist visas for 6 months.

But the officer can deviate from that at his or hers discretion.

Unless your stamp in the passport only gives you to a certain date (which sometimes happens if they feel you travel too much), you will have been given 90 days on the Visa Waiver program. You can stay that long, even if you said at the border you were only staying a week.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

VWP is 90 days or nothing, B can be for variable times.

When my wife came to the U.S. prior to the approval of our K-1, she came on a visitor visa. She gave them the date of her flight back which they listed on her I-94. She changed her flight to stay longer. The original return flight date was on her I-94 as a red flag until she departed the U.S. Once she departed (less than six month stay, so no overstay) The red flag disappeared and her I-94 then became current. When she returned on the K-1, the I-94 showed her previous arrival and departure with no negative marks on it.
