Does my fiance need to submit Tax return

I just am trying to understand whether she will have needed to file a tax return for 2014. In this instance, she worked for 3 months in the UK, but earned under $10,000 in total. DOes this mean that she does not need to have submitted a tax return for this year? Also, because the money was earned abroad, would she need to submit the foreign earned exclusion even if she didn't earn above the threshold? We are currently in the process of applying for a K1 visa and want to make sure everything is in order.

Any info would be massively appreciated.

the uscitizen, the petitioner, is the one that fills out the I-134.

The human you wrote about, is that a USCitizen ? If yes, then restudy F2555 IRS form.

Yes, she is a US citizen. She was living with me in the UK while she was a student, but her visa allowed her to undertake part time work here. She did so for 3 months, but only earned $2000 dollars in total.

I'm well aware that she fills out the I-134, but she does not know if she has to file for 2014 due to the low amount she earned.

What was the total worldwide income for the year? If it exceeds the filing requirement then she needs to file a tax return. If it did not, then she would include a signed statement giving the reason (earned under the filing requirement) that she did not have to submit a tax return.

It was only apporx $2000 for her total worldwide income, as for most of the year, she was undertaking a masters degree. In that case, just get her to write up a signed statement then?

The answer to your original question is No to filing a tax return for 2014 because her total income for the year was $2000.

She will not have to include a tax return for her I-134 (taken to your London interview.) 100% sure of that. She can prove her income to London with a letter from her current employer. if she chooses to also send a tax return, it will be 2015 by the time you interview.

The first time she will have to worry about a 2014 tax return is after you are in the US when you file for your adjustment of status. She does a new affidavit of support I-864. By then her most recent tax return will be 2015. She can add a signed statement (in place of the 2014 return) that says she did not file a tax return in 2014 because she was a university student and earned only $2000 in tax year 2014. Try to be specific about the amount like $2013.55. It looks better.
