Never received I-797, can I still AOS with other paperwork.

Hi,

So I'm putting together the AOS paperwork and find that I need form I-797 which I can't find anywhere.

I need to be able to work as soon as possible. I got married on the 8th of Jan 2016. I was hoping to get my AP and EAD ASAP!!! Which from the times I've seen would be around 2-3 months optimally.

I don't understand why I don't have it, I have held on to every piece of paper with great care. I was wondering if my now wife would have received the NOA2 I-797 paper (I'm the english fiancé btw). But she says she can't find it and only received a NOA1.

I did receive my I-129F back in the post with a big approved stamp on it. Would this be enough if I sent off my AOS paperwork?


Furthermore, I really need to be able to work and be able to leave the country so need to apply for the EAD and AP, but would need to apply alongside the AOS.

I know I can apply for a duplicate with form I-824 but this will take months to get I assume. Could I apply for AOS/AP/EAD and then do I-824 and expect an RFE when they get around to doing my AOS and still be able to get the permits?

Any advice or help is greatly appreciated.

NOA2 would have been sent out to the petitioner not the beneficiary, it is the notification of the petition's approval.

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

31 Jul 2014: Mailed AOS Packet

12 Feb 2015: AOS Interview - Approved

--

22 Feb 2017: Mailed ROC Packet

08 Aug 2018: ROC Approved

In lieu of the actual I-797 NOA2 visa petition approval letter, some folks have had success submitting the email notification message USCIS usually sends prior to sending out the official notice.

My Wife didn't receive an email or NOA2 in the mail. To be honest the USCIS have been pretty terrible throughout our application since the beginning of our k1, they didn't even send my paperwork back to the right address (a completely random person in the UK received it and gave me a phone call telling me they were holding my paperwork, but that's a whole other story)

I do have the NOA1 email and mail though with the receipt number. I just went online to the USCIS and entered it and got the first line as so


"On May 13, 2015, we approved your Form I-129F, Petition for Fiance(E), Receipt Number WACxxxxblahlabhalbhal"

Is this the one I'm looking for, or do NOA1 and NOA2 have different receipt numbers?

That's what you need. The NOA1 and NOA2 have the same receipt number

The receipt number throughout the whole process should have been the same.

21 Aug 2013: I-129F Sent
