Ok. Here is the update.

We went to USCIS local office last week to request for an I-130 form. The officer told me that my husband cant file I-130 for my son since the stepfather-stepson wont be established since we got married when he is already 20 years old. Here is her suggestion:

I do my AOS first. As soon as I get my green card, I will file for I-130 for my son and he will file the AOS for himself.

She said they have emailed USCIS head office and told them about my son's situation. Unfortunately, they havent replied back. She suggested to have my adjustment filed first.

My husband called USCIS customer service and the person he spoke to said the same thing.

Oh, the suspense! The stress!

Thanks for the update. This is crazy, the embassy issues the visa, CBP allows entry, but then USCIS doesn't allow him to adjust status... DUH!?? :wacko:

1. file the I-130 with the I-485, concurrently. Include a letter about the age out. USCitizen is petitioner.

2. No news of finding Randy W's stuff here? He's posted a lot about it, age-ing out and how to get in properly.

IMO, going to USCIS office was a waste of time. tempus fugit...

Hi Darnell,

The problem with filing I-130 for my son : my husband wont be able to establish the stepson-stepfather relationship since I married when he was already 20 years old.

I will be the one to file the I-130 for my son as soon as I get my green card and he will file the I-485.

I am trying to find Randy W's posts but I am having a hard time since I am just using my old almost useless smartphone to access the internet for now.
