If you want a change of him adjusting status and not being sent back to the Philippines... Yes submit the I-130 application (with fees) along with the I-485 (and fees), just as USCIS suggests in the link I gave you earlier.

Yup, you are definitely correct, Hank.

Sorry, I was only able to to read the replies just now and I paid a visit to the local USCIS office and also called their hotline earlier this week.

The officer I spoke to at USCIS (hotline) said that I dont have to pay for the I-130 anymore. I just need to attach the approved I-129F.

Well that is good to know, so you complete the I-130 then attach a copy of the NOA2? Cool! Send all that along with your I-485 and then....... wait. ;)

The officer told me to attach a copy of the approved I-129F. We Are scheduled to visit the USCIS accredited doctor early next week then we will file the petition. God, hopefully everything turns out in a positive note ? Edited by Mydy

Do you have a copy of the completed I-129F with approved stamped on it by USCIS? We don't. We have the I-797c, NOA stating the I-129F petition is approved.

Yup, Manila US embassy sent me a copy of the I-129F with approved stamp. It was included in the packet. I will include the NOA2. Edited by Mydy

Lol.

So if someone did not recieve the packet, NOA2 is a good "replacement" for the approved I-129f? Maybe the reason why the officer told me to include the I-129f is because it will cover the I-130.

I will inform everybody the outcome of this petition as soon as I get a response from the USCIS. Hopefully, they approve the petition. Keeping my fingers crossed. We will be filing this after we get the vaccination supplement from the accredited USCIS doctor.

Oh ok. Now I am thinking if I should include the evidences needed for the I-130. I forgot to ask the officer about it.

I would tend to treat the I-130 application as just that and provide everything listed in the instructions for the I-130, hopefully you can contact USCIS on this for their input.
