Hi,

I am wondering how do I withdraw the petition for my wife from South Africa who has now received her 551 stamp. I have been told to contact the Josie Embassy in South Africa. My wife has not entered the USA as of yet but just go the stamp. She will be arriving a couple of months. Do you know what they will ask for or what I should do? I have contacted the Embassy but they don't respond by email very quickly. Any experience in this matter?

The passport is stamped at the US port of entry. Do you mean that she has received the visa that you petitioned for?

It's her visa. You can't withdraw anything, including the affidavit of support.

There isn't much you can do at this point. Did you guys not have a bonafide marriage? Did she trick you into getting her visa? If you don't want to be with her then a divorce is in order but that visa she has in her hand is hers and you can't do much unless you have major proof of fraud..

she has not entered the united states.

You're no longer in the visa process and as you want to stop your wife from coming to the US, that is a major effect on immigration and fits in this forum.

I'm going to disagree with the other posters.

Until she gets that visas endorsed you can pull your AOS. Call, fax, email the embassy that she interviewed at let them know that you are pulling your AOS.

Call email and fax the border/POE and do the same.

Your post makes no sense. Either you are using the wrong terminology or there is something you are not telling us.

The I-551 stamp in a passport indicates that the applicant has received green card status. There is no way your spouse got a 551 stamp with out entering on her visa first.

So either your spouse entered on the visa and then left again, OR you are referring to her having the visa in her passport (not the stamp) and not having entered yet. These are 2 very different situations.

If she entered on the visa and got a stamp- there is nothing you can do at this point to withdraw. If she only has the visa and hasnt used it yet then like stated above you can cancel/withdraw at any point until her POE.(entry to US)

If she has not entered , you can email fax phone them & inform CBP with good reasons

theres a poster here who husband stopped her kid from coming by withdrawing after the

kid interviewed in embassy.So you can get on it

If she has I 551 then she already entered & left maybe & did not let you know if you both no

longer are together

Yes I was wrong about the 551 stamp. it has not been given as she has not left. i called the us consulate of south africa and they told to me to send an email to revoke which i did but now they told me to send the email for revocation of the marriage visa to the uscis of johannesberg.

does that makes sense to you?

thank you guys for all your input you are quite experienced in these matters. quite impressed and grateful for your candid responses.

also which border or poe ( i am in los angeles area) and she would be either flying into los angeles or new york at some point. do i call and can that be the stopping point for me if i can't get through the uscis of johannesberg?

If they're telling you to contact USCIS in Jo'burg, do so as a priority.

If you get no word that the visa has been revoked, all that you can do is to notify the CBP offices at the probable airports of entry. I'm not sure how seriously they'd take you, in the absence of proof beyond your word; you ideally want to have something in writing from the consulate and USCIS/Jo'burg, so keep printouts of all your correspondence. You should request to speak with the CBP Shift Supervisor.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

ok - some other follow up.

for her visa to get invalidated,

you need with officially withdraw the I-864, affadavit of support.

if you have a fax number to the IV Unit in South Africa, that would be the ideal intake point to get it done.

If you don't have that fax number, call NVC when they are open, punch option 3, and talk with a human there, asking specifically the fastest way to get the official withdrawal of I-864 notice into the IV Unit there.

If the I-864 is officially withdrawn, there's no need for any USCIS office involvement - IMO the clerk that gave you this info is wrong.

ok thank you darnell that makes sense since that is the reason for actually the visa issue with my wife because I can't provide support to her. I have contacted the IV unit there in Johan and they said that I have to talk to the USCIS.Johan unit and when I did that I am to contact the uscis of the usa local office. all this running around is just crazy to be honest.

ya, that's what i sensed, after reading your posts here - you were getting the run-around.

A Vice-Consul at the IV Unit will see your faxed letter, withdrawing the I-864, and will have to revoke the visa. I am unsure how the visa gets revoked, but it's a Vice-Consul that starts the process of revoking the visa. A Sponsor (YOU) clearly stating that 1] you are withdrawing the I-864 and 2] you are requesting the visa be cancelled; gets some action at the IV Unit.

It's exceptionally rare that any Vice-Consul answers a telephone - I'll guess that you spoke with a native consulate worker instead. Not any USCitizen on the Vice-Consul staff.

that is correct. i asked for a consular officer and now i have been told through the security officer during after hours that i should talk to the chief consular officer. i guess i can call them for their IV unit fax number and do the cancellation of the I-864 as requested correct? do i specifically withdraw that part of the petition? i was also told to write a statement why and i did that but they rejected it and that is where i talk about the run around from the us consulate johannesberg.

1. not need lengthly explanation on the 'why'. usually people write about an upcoming divorce or finding proof of infidelity

2. The Vice-Consul is supposed to act on the official letter requesting the withdrawal of the I-864 without any reason stated.

Please practice a bit, writing up this letter of withdrawal, making it 'sound' more like an official request rather than just a personal notification.
