After my fiancé gets the visa: procedural question

From what I was reading at the bottom of the guides, the K1 is basically one-use. If we wanted to travel before the wedding, she might run the risk of not getting back into the States.

We had wanted to go to out of the country shortly after she arrives but it looks like this might be ill advised.

Has anyone had any experience with this?

Should I set up a wedding really fast?

Once she uses the K1 and crosses over into the US she can't leave until she receives her combo card during the AOS process. If you really move on getting things done it could take around 5 or 6 months.

2015-03-07: Got engaged (L)

2015-03-30: Sent I-129F to Dallas lockbox

2015-04-14: NOA1 Packet received, sent to CSC

2015-05-07: NOA2 Approved!

2015-06-15: Received Packet 3 by mail

2015-06-17: Sent Packet 3 to Consulate

2015-07-14: Received Packet 4

2015-08-10: Medical in Toronto

2015-08-16: Received medical envelope

2015-08-24: Montreal interview- APPROVED!

2015-08-27: Visa arrives at Loomis location

2015-08-28: Visa in hand!

2015-09-17: Entered USA

2015-10-23: Married!

2016-01-11: Sent AOS Package I-485, I-765, I-131

2016-01-21: NOA1 Package received

2016-02-19: Biometrics

2016-04-01: AOS interview- APPROVED!

2018-03-19: NOA date, 2018-03-24 letter rec'd

2018-05-18: Biometrics appt waived

I thought you could leave the country if you file for "advanced parole".

10/31/2016 - Received hard copy of AP in mail.

 

11/05/2016 - Received Employment Authorization in mail.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You are applying for a K1 fiance visa.. that means, she comes here and you get married and then you can apply for EAD/AP/LPR. it isn't a visa where you can just travel back and forth. If you are waiting to travel, then do that before she gets the K1!

It surprises me sometimes how so many people wait what seems like forever to get the K1, and the minute they get it, they want to leave?

Excuse me, I'm not looking to run away. I'm just inquiring about the process. We had though about once we were able to be together forever and get married, maybe we'd want to go away on.a honeymoon or something.

Just plan on doing a lot of filling out of documents as soon as she arrives after you get married, and do a little waiting. You can ge the AP pretty fast (<90 days) and sometimes the GC is approved fairly quickly as well. This will allow you to travel (once you get approval). My wife received her GC in about five months, and soon after went back to see her family. I joined her a few weeks later and we made a vacation out of it.

You are right. K1 visa is void as soon as she enters the United States. If she leaves without an approved AP or a green card, she will not be allowed back in and you would have to refile a k1 or a spousal visa, depending on her marital status when she left USA.

So you have 2 options:

1. Get married fast, file AP + EAD + AOS, and wait the 90 days for you to get the AP, then take the trip

2. You meet her in that 3rd country and have a pre-honeymoon and you both come back and she enters with the k1; (and maybe if you have the budget for it, plan an actual post-wedding honeymoon which I'm sure she will be thrilled about.)

I am not saying you want to run away, and please do not attack me. Immigration is a process. I understand you want to go somewhere, but unfortunately it is a wait and see what happens process. Immigration is very $$$ and time consuming. You can not plan anything because you do not know when you will get the GC or AP to travel. Travel before, and once she gets here it is a waiting game. I am just trying to give you some solid advice:) your priority should be to bring her here, marry and then file for the paperwork. Unfortunately, immigration will put your life and travel plans on hold. Go to Hawaii/California/Florida if you really want a vacation within 2 weeks of marrying her.

Did she get the K1 approved? When does she enter the US? When is your wedding date? When are you sending in your paperwork? So if your question is she can leave the country shortly after she arrives the answer is no, she can not leave the country shortly after she arrives. Focus on filing the paperwork and getting the legal status to travel and build your lives in the USA. if you really want, you can do your 'honeymoon' before you get married:)

Or, if you are that caught on on getting married and having a honeymoon outside of America, you can apply for the CR1 visa.
