Hi

So I am about to send all the paperwork for AOS (K-1 visa) and we are using my husband's dad as sponsor. The trouble is that his dad filled joint taxes with his wife. Now the question is on the I-864 what do I put for total income??

Do I use total income line 22 from tax return and attach the copy of his dad W2 which will show how much is he making?

I read some posts that his mom should filled I-864 A, is that correct? i was not aware of that.

what is the best practice to go with it??

I want to mention that his dad makes enough money and it is behond 125% of his own income, so I do not really want to involve his mom in it, but do we have to since they filled out the Taxes Jointly??

I agree with this one. But I would suggest that Dad gets an employer letter and six months pay stubs just to make it blatantly clear what his separate income is. Don't forget to include proof that he is a USC.

Yes, i have his employement letter that highlight exactly how much he earns. I do not have his paystubs though, but I think it will be sufficient. The letter is pretty clear.

If you send your AOS before tax due date (April 18 this year) then his latest return is 2014. Do you have that? He is required to send his latest, even if it's not so good. If you have an employer letter showing he makes enough currently, then it doesn't matter if he didn't make enough in previous years. They can approve if his current income qualifies as long as you have proof.
