Hi guys,

Last night I discovered that the certified translation of our marriage certificate that we sent to USCIS in September 2015 contains a mistake. The mistake is in my birth date (translation says April while it should be June). Of course in the same package we sent to USCIS the petition I-130 with my correct birth date, as well as the biographic data form, also with correct birth date. The mistake went unnoticed and our case was approved in November and sent to NVC.

I started gathering documents for AOS and IV packages. The checklist from NVC says they want the marriage certificate with translation again (why? I don't know since I thought they received it from USCIS). That's when I noticed the mistake on the translation. Of course I will contact the translator today and ask her to issue another certified translation without the mistake. But what should my next step be?

Should we:

a) Submit the marriage certificate plus new translation (without mistake) to NVC and hope that nobody there will notice the mistake on the translation sent to USCIS?

or

b) Submit the marriage certificate plus new translation (without mistake) to NVC, and also write a letter acknowledging the mistake on the previous document and explain it? If so should the letter be sent just to NVC or both NVC and USCIS?

I'll be grateful for any advice.

Thanks,

JJ

Don;t worry abut USCIS and what you sent they don't forward that that's why NVC asks for them from everybody. Get the correct copy and submit and not worry about it.
