sending I-130 from abroad (merged topics)

I am filling out the I130 for my husband, I live in Bosnia with him and two of our children (both of my children are USC) I am aware that we need a joint sponsor.

My best friend that lives in the states will be our joint sponsor, but she does not live in the state that we will move to.

How I understand the process:

1. I send in the I130 (with the documents proving my US citizenship and marriage), G325A for my husband and I, correct. The joint sponsor sends the form separate or all has to go in one envelope?

2 Is it correct that the joint sponsor does not have to live in the same state?

3. I have not filed taxes since 2008 since I have not worked much in Bosnia and the yearly income is way less then it states on the IRS website (when to file is obligation)

But someone told me that they have been filing even if they make less the amount IRS states on their website.

4. I am aware that when the interview come that we have to prove domicile in the US. We where planning to register our kid for school and have a letter from our friends stating we will be staying with them.

I hope I did not miss anything.

It's not necessary for the joint sponsor to live in same state. They only need to live in the US.

The joint sponsor will send their financial documents with yours when you get to NVC. That's months later after the approval of the I-130.

With your I-130 your focus is evidence to prove bonfide relationship. Be sure to include the children's Birth certificate also.

When you do your I-864 you will write a cover letter explaining why you did not file for the 2015, 2014, 2013 years. Didn't make enough, wasn't required.

Thank you so much for your reply.

Is it alright on form I130 to leave number 18 blank since we do not have a address in the states, yet.

USCIS here in Bangkok told us just to write "Unknown Address" and fill in the city and state. For us, when it comes time the plan is for me to go to Honolulu and get things set up, and then my wife will follow in a month or so. USCIS doesn't seem to think this is a problem.

Since we are going to have a joint sponsor I looked at the table about the income requirements. Since my joint sponors lives on her on and she will be sponosoring my husband that means household members 2, that means she has to make around 20k is that right?

I am ready to send out I130 and the other documents required. I live in Bosnia with my family. I am not sure how should I send this in the mail, regular mail or DHL, UPS?

Up to you. I would use a courier service with some form of online tracking and insurance as you have a cheque or money order for $420 in there.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

That is what I am thinking, too. I do not want my papers to get lost in the mail.

Since I live abroad I will be paying the fee at the consular office that is what I read. I will call them to find out. Since in Bosnia I can not get a money order!

I am not alone!!

We are about ready to send in our I130 this week for my husband. My daughters and I are USC. I live in Bosnia with my husband and two daughters and will be sending the I130 and required documentations form here (Bosnia). On our I130 and G325A is our address abroad, we do not have one in the US at this time. .

I was not aware of the auto-expedite process that we could qualify, I hope. I have ready many of your posts and did know that I could explain in the cover letter that I live with my family abroad.

Also I did not know sending extra documents of proving that I live here. What can I use?

-Medical insurance card issued by authorities

-Get a letter from my empolyer

-Birth certificates of our daughters born abroad (will be sending anyway)

-Do I need to send pictures of our family at this stage?

-What fact are they (USCIS) looking for proving I live abroad?

If you can send it with UPS do it so that you can track the package. DHL only tracks it until it leaves Bosnia, as I have found out.

Any documents that can prove that will be good. And yes, you enclose family pictures to the petition.
