Hello everyone, I really need a quick answer on this one, it could mean the difference between applying for AOS and having to leave my wife in the US for many months to come.

If I file form I-130 and form I-485 without the medical examination (I-693) tomorrow will my request be most likely denied/rejected? Or will I recieve RFE?

I entered on a B2 Visa, I know that I should send in the medical examination as well, but I can't, will my request be most likely rejected?

You will get an RFE. If you do not satisfy the RFE with a medical exam, the case will be denied.

Why can't you get a medical exam and send it in with the AOS?

Based on my experience , I also did not submit my I-693 because the doctor is only available after one month and time is of the essence in filing. Just mention in your cover letter that you are concurrently filing but with out your medical record and state the reason why. I reveived an RFE but they also mentioned NOT to submit it yet if I have it but to wait for further notice on when and how to submit. So you will not be denied just RFE.

You will receive an RFE (request for evidence) which usually gives you about 87 days to have the evidence returned to them. If you try this route and are unable to obtain and return the medical in that time you will be denied and the money will be lost. From your previous post I have to ask does your spouse make enough for the affidavit of support? Do you have a joint sponsor? Do you have someone you can borrow the money from or get a loan. It is always best to send the most complete packet you can to avoid stress and delay.

you need to send the medical in the adjustment of status packet, unless you entered on a k1 visa

You are mistaken. USCIS no longer requires the I-693 to be submitted with the I-485, though many still choose to do so. Since I-693s are only valid for a year from the date on which USCIS receives them, it can make sense to delay submitting a medical until USCIS specifically requests it, either through an RFE or an interview notice.

  • Submit Form I-693 by mail, together with your Form I-485, Application to Register for Permanent Residence or Adjust Status, to the location specified for your Form I-485 (see “Direct Filing Addresses for Form I-485”).
  • Submit Form I-693 by mail, after filing your Form I-485, to the location specified in your most recent communication with USCIS (for example, a Request for Evidence letter from USCIS).
  • Submit Form I-693 in person, at an interview in a USCIS field office (if an interview is required)."
