I have a question. I will be using a joint sponsor because I have been in my husbands home country for the past 8 years. As I was there on a spousal visa and was never approved for a work permit I did not work during the time I was there. Therefore I did not file a tax return during those years. I did not receive enough income in 2015 but I will put what I did earn on my I865.

My question is, what exactly do I need to explain my lack of tax return? Just a self written notarized letter?

Any advice would be greatly appreciated.

You send in a signed letter with the I-864 stating that you were not required to file US tax returns for the last three years because you did not have any income. That's it. It's that simple. No need for a notarized letter. Just a simple sentence with your signature.

You can actually hand write in the tax section of the affidavit. "Not required to file. No income"

On the new i-864, there is now a box you can tick if you have not been required to file taxes. My husband then attached a signed and dated letter saying: I confirm under penalty of perjury that I have not been required to file taxes for the last X years due to XYZ".

OR, you can write on the affidavit itself, which is signed under penalty of perjury.
