Hi. I'm new here as my coworker uses this site. So my husband and I have been together for 3 years and we resently married in November. We have spoken with a lawyer. But I want to ask a question if anyone's wife or hisband is in the United States illegally. My husband came when he was 8 or 9 went to school here he doesn't have a criminal record. Has anyone filed for their spouse who is already here illegally? I'm just trying to have some faith that we still have a chance. We have 1 child together 2 from previous relationships and one one the way. I don't know what I'd do without him.

Did he enter legally? Through a B1/B2? If so, you can petition for him and he can adjust status in the US.

If not, he will need to go back to his country to continue with consular processing. If he stayed in the US illegally for more than 1 year then he will have a 10 year ban. However, you can overcome the ban by filing waivers (I601/I212).

June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
