Out of state student ?

Hello,

I will soon be moving to the US and among other things I am also interested in continuing my studies at a college. My question may be quite simple but what I would like to know is; if I arrive in NJ, am I going to have to pay for out of state tuition until I have stayed for a year? It doesn't make a difference that my fiancé is a NJ resident. I am basically an out of state student for the entire USA?

It depends on the school. It depend on the laws in the state of your residence. It will depend on your marital status and how long your spouse has been a residence. Since you can only have one state of residence, you would be treated as an out-of-state student in the other 49 states regardless.

Contact the school you want to attend. Each school has its own policy on charging out-of-state tuition. There is no one answer for you because it depends on the school.

Which school do you intend to attend? NJ seems to have more lax rules than TX, but it seems that it may be institution specific too.

For price reasons I am currently thinking of applying to a community college, I'm not sure which but would it make any difference as tuition is determined by residence/state and not by college? Basically what I'm asking is if a person entering on a K1 visa an marrying a certain state resident (in this case NJ) will he or she receive residency through the marriage or will the person remain out of state (and that way not really belong to any state for a year)

Your domicile is in NJ, so you do belong to a state. However, I haven't found any state regulation on an initial search. Texas has the issue regulated so it's quite consistent in all educational institutions around the state. If it's not regulated in NJ, then it may be up to just that school. I found one university that will allow a student to take claim residency based on their spouses residency status and one community college that only requires your green card and something else easy, like a drivers license or something. (I can't remember, but it was only those two things.)

Some states do allow the K-1 beneficiary to get resident rate tuition based on a marriage to the USC, but some others require more stipulations. Without knowing the school which school you are considering, I would suggest you contact the school on this issue; especially if it's determined by each institution.

1. As far as I've understood I will automatically become a resident when I marry my fiancé and show that I live in said state.

2. Planning on applying for NJ colleges, as an in state student! :P

3. I don't think they write "friendly" on the job offers for cc admission offices cause not that many have that quality, but hey I got my questions answered haha

Have you spoken to any of these schools? It looks like there are requirements that must be met, including living in New Jersey for twelve months for most cases. http://www5.njit.edu/financialaid/costs/residency.php

"D. THE EFFECT OF MARRIAGE or CIVIL UNION: A non-resident student who marries or enters into a Civil Union with a bona fide New Jersey domiciliary assumes the domicile of that spouse or civil union partner for tuition purposes in the semester following marriage or civil union"
