You can get married on a visa waver, you just can't overstay on a visa waver if you do that. You could go to the US to get married and then come back to Canada, file for a spousal visa and then you'd get a green card and be able to move right away. I did get married on the visa waver to my ex... but we never applied for a visa for the US as I was staying in England and he was going to come here. It wasn't illegal. It's only if you try to over stay that it becomes illegal. There is a way to adjust from visa waver, but it's only suposed to be used for exceptional circumstances.

Canadians don't need Visa Waivers.. it is considered a B2 visitor visa, although they dont usually stamp your passport they generally have a record of it. So you have 6 months to stay in the country....She is worried about paying for immigration so IMO it is more important for her to stay and adjust through the CR1 while she has a job and is making money. Why get a K1 fiance visa to come to the states and not be able to work for 4-5 months? Especially when you are right across the border and seem to be very close. It is not as easy as people think it is to get a high paying job in the USA.

Just a clarification. You are recommending staying in Canada until the CR1 visa is granted, so that when it is used to enter the USA, work authorization is immediate. You do not "adjust through a CR1". Upon entry the status one might otherwise be granted by "adjusting" is immediately granted upon entry with the CR1 or IR1 visa. No adjustment occurs.

Facts are cheap...knowing how to use them is precious...

What? Yes, that is what I said. Stay in Canada and do the CR1 so he gets his GC and work permit and can immediately work upon moving to America:/ maybe I didn't word it correctly, but I think she understood the process.
