Hello everyone :)

My wife and I got married on the 1st of January 2016 and we're starting the process of getting me a permanent residence here in the US, both of us have spent countless hours searching and reading online, this website stood out the most in almost every single search we made and there are a couple of things that we'd like to get right, so here we are.

Some of these questions might've been answered before, but I would like to be 110% sure that the answers apply to our case too, please forgive me if I ask something that's been answered before.

Allow me first to tell you a bit about our situation:

I came to the US for the first time on April last year on a B2 Visitor visa and spent 6 months in the US, I met my wife at a mutual friend's daughters birthday party, became a thing on the 16th of June, left the US around the 26th of August, came back on the 27th of October and was granted 3 months stay in the US, got married on the 1st of January and must leave on the 26th this month.

We have (to the best of our knowledge and from what we've found online) filled form I-130, I-485, I-765 and G-325A, here's what I'd like to know:

1. If we file Form I-130 alone, will I have a case at the USCIS office? Meaning will I be able to stay lawfully in the US after we file Form I-130 alone?

2. If not, how long does it normally take (I know it varies, I'm simply looking for an average) after mailing form I-130 and form I-485 for USCIS to assign me a case number or whatever they do to show a case pending?

3. If USCIS receives the package that includes form I-130, I-485 and form G-325A and assign me a case number and send me NOA1 then I can lawfully overstay?

4. I know that we need to include a medical examination form alongside form I-485, we can't do that for many reasons including financial ones, is it okay to send in forms I-130 and I-485 and G-325A alone with no other forms what-so-ever? what are the chances that our application will be rejected by doing so?

That's all I could think of for now, thank you guys for providing everyone with such a great forums :)

Regards,

Palestinian
