hello everyone i need some advice from anyone in here hoping that someone can help me with my problem, i am 2yr GC holder which will expire this sept 2016, unfortunately i made a huge stupid mistake last May 2015 i was caught shoplifting, officer gave me a ticket for misdemeanor but no jail time and no fingerprinting that happened. i hired an attorney got my case dismissed had to pay a fine and im on probation for 3 years which says that stay away from the store for 3 years and stay out of trouble thats it. Now i have to file for ROC this coming july do you think i would be having any problems or would my petition be denied because of that? plus what are the documents that i'll be needing? pls no judging i know what i did was wrong im fully aware of it and would never do it ever again i hope somebody can enlighten and help me. thank you in advance

Whatever it is, have to fully disclose it to the USCIS, if they learn about it, not the incident itself, but the fact that you have misrepresented yourself on the form, and is reason for deportation.

At our local USCIS, even got so critical as to report your parking tickets, even though the instructions tell you, you don't have to.

Very familiar with the certifications in this country, and you meet with a board for the final decision, but not with the USCIS, only dealing with one individual, somehow, this doesn't seem right.

Once case of shoplifting should not affect your ROC.

I am pointing this out because you ask about consequences. This is not about judging you. This is information for you. There was a Vietnamese woman who had her green card revoked and deported after 3 shoplifting incidents. She left her husband and children behind in the US.

You need to disclose the citation/arrest and provide the paperwork dismissing the case.

I have a similar charge from 2008. made that choice to steal and had to deal with the consequences.

I hired a lawyer in 2013 and he said i will be okay despite my arrest record. I was approved. I disclosed everything and certified copy of my record. The IO asked one question about my arrest and thats it. I was approved the same day.

And didn't have any problems with ROC as well. Of course I disclosed everything again.

Every time i enter the country i'm stopped at the POE. Be honest to the POE officials as well.

thank you so much now im on my probation for 3 years, this just happened last 2015 so my attorney say that i can only get my plea record with the court seal i can get my case dismissed or file for dismissal after my 3 years probation is done. they also say that i have to specific on what paper work that the immigration need coz the court will not just give everything

thank you so much cocole i have one question for you did you try to apply for citizenship? if yes how did it go?

Sorry for the late reply. Yes i did my Oath last week. No problems at all. At my N400 interview i was asked if ever been arrested i answered “unfortunatly yes and i regret it everytime i think about it “. The interviewer told me we have all done something in life we are not proud of and she approved my case. Then i got oath letter within a week. 

My advise to people in similar situations is be completely honest with USCIS or any immigration official for that matter. 

People in similar situation who are applying for GC get at least 4 certified copies of arrest and court disposition. You will need it for GC, ROC and N400. And the fourth copy for your record.

What does your final disposition says? Dismissed with the plea of guilty or not guilty? 

1 misdeminor should not prevent you from getting a GC, but you need to go to courthouse, request all your record and final disposition then take it to immigration layer who also knowledgeable  about criminal law for review just to be on a safe side.
