We married last Sunday and my social security number arrived this week with the unauthorised to work bit on it but when I applied in the social security office, the guy who helped me said I would receive a pink card allowing me to work in about a month but I have not been able to find any more information on that!
Now what do I do, what is the best road to go down? To apply for an AOS or to apply for an EAD or is there another way I don't know about!
The AOS will cost about $1000 to file which is money I just don't have at the minute.

Just what do I do :(
I appreciate any help!

SSA individual is wrong.

In order to work in the USA legally and continue to have legal status in this country you need to file AOS. If you file for AOS with EAD and AP, the fee for the EAD and AP will be waived. The cost is $1070. My suggestion is that you and your spouse save what you can and file as soon as possible. It protects the foreign spouse, as if you continue to stay in the USA you will be doing so illegally and you will be unable to work.

EAD is a temporary permit that will hold you over until your green card is approved. EAD is usually approved somewhere around 90 days.

You do not really have a choice, you must file AoS. At that time you can also file for EAD/AP-which does not have an additional fee when filed at the same time.

you knew you ad to file AOS, why did you not plan in advance for this fee? People should have to prove they have the money for AOS before their k-1 visas are issued as far as I am concerned. So many people get here and postpone AOS or never bother to do it at all. What a broken system

This was being discussed on another thread this morning.

You really need to read the Guides.

Adjustment of Status is part of the process, not an optional extra.

This is not entirely correct. As long as you fulfill the requirements of the K1 and get married within 90 days, but wait to file the AOS, you are not in an illegal status. I agree that you cannot work legally, or re-enter the country if you leave prior to an AP/GC, but USCIS will not be looking to deport you as an illegal. Many people wait months to years to the file the AOS (I don't advocate this) for a variety of reasons which puts them into a sort of limbo status. My advice, like many others, is to find the $1070 and file the AOS as soon as possible to allow for an easier transition to the US.

Good Luck!

If not an illegal status, then what's the person's status between the time the I-94 expires and AOS is filed for? Limbo status is not a choice. It's either legal or illegal.

Dude, a K-1 visa overstay who is here past the 90 days is here illegally. Meeting the K-1 requirements by marrying within 90 days is not a legal status. A K-1 who marries outside the K-1 requirements and overstays is in the exact same position as the K-1 who marries within 90 days and overstays.

Sorry but if you marry and fulfill the terms of your K1 and you remain in the US without adjusting your status and your K1/I94 has expired, you are out of status. Being out of status and doing nothing to protect yourself and give yourself legal status, is being of illegal status. You can argue that it's a limbo status, and the government may not actively be searching to deport you - but you are illegal-by-overstaying nonetheless. Whatever reasons people have for not filing are their own reasons, and doesn't change the fact. As Boiler said it's not an optional extra.. it's a part of a two-fold process. The prospective immigrant and their spouse should understand that it's important to make every effort to adjust as soon as possible.

You do not have to file for the green card right away. You can wait. However, there is no "we" in making some money. You are not authorized to work. Only your US citizen spouse will be working legally. If you want to work legally, you will need an EAD which you file for with AOS. If you do not file for AOS before your I-94 expires, you will be here illegally as a visa overstay.

Never listen to the SSA office. Seriously, like, ever. There is no pink card after receiving a SS Number giving you authorization to work. Authorization to work only comes from applying for AND receiving your EAD.

If you do not file your AOS before the expiration of your I-94 you are out of legal status, and are considered here illegally. Though it's unlikely to happen, if you happened to be stopped for some reason by law enforcement, you could be subject to deportation proceedings after that I-94 expiration.

Filing for the AOS is mandatory if you want to work legally and remain in a legal status in the country. Anyone with even a cursory understanding of the process knows this and should have prepared well in advance for the fees that would be necessary.

I would come up with the $1,040 with the quickness. You need to consider long term what's more detrimental. Fronting $1k, or losing a lot more than that through you not being able to work, and being here in an illegal status for your trouble.

This is my Second trip through this, and I just checked and things have not changed.

You can file for permission too work separately from Adjustment Of Status. It costs $380.00. Later you can file for an AOS and the cost is $1,070 or there about so you will be paying more by going that route.

Good luck........
