petitioner's court record (spouse visa - CR1)

I just want to ask if the petitioner's court record is really needed in the interview for spouse visa?

interview will be at US Embassy Manila

I will really appreciate any response or share their experience. Thank you in advance.

USCIS

July 28, 2015: File I-130
July 30, 2015: NOA 1

August 31, 2015: NOA 2

NVC

September 18, 2015: Case was received by NVC

September 29, 2015: Case number and invoice ID number assigned

October 5, 2015: Filled out DS-261

: Paid AOS bill

October 28, 2015: Received and paid IV bill

November 2, 2015: sent AOS and IV packets

November 3, 2015: completed DS-260

: Scan date

December 8, 2015: Case complete

December 28, 2015: Medical

January 20, 2016: Interview

: received 221g

January 26, 2016: US embassy received documents

February 3, 2016: Status changed to "issued"

Yes, your spouse needs to bring the original police certificate and court record (if there's any) to the interview. The police certificate is very important.

hi. I am the beneficiary and I have my police clearance to bring to the interview. I'm asking about my husband's court record. Do I really need to bring it to the interview? The I-130 didn't ask anything about criminal history.

Anyone here who got denied for the spouse visa because the beneficiary didn't have the petitioner's court record at the interview?

According to the NVC website:

If you were convicted of a crime, you must obtain a certified copy of each court and prison record, regardless of the fact that you may have been granted amnesty, a pardon, or other act of clemency.

  • You must submit a photocopy of each court and prison record to the NVC.
  • You must submit a certified copy and one photocopy of each court and prison record to the U.S. Embassy or Consulate at the time of your interview.

As far as I know, you don't need the petitioner's court record. NVC and the consulate only requires it for the beneficiary. And even if your husband did have some court record, the NVC should have asked for that before your interview. I think you will be fine but do check with others who have interviews in Philippines. Also, search around visajourney to see other posts on court record.

Nope, you do not need to submit the petitioner's police certs, criminal record or anything like that. They already have it from the background check on the petitioner during the USCIS process.

My husband is currently in prison and I had my interview back in December. We didn't have to show anything for his record but I was asked why he was in prison, so make sure you as the beneficiary is aware of your husband's criminal record.

Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license
