Hello everyone,

I am out of status but i am married to my wife for more then a year now, we decided finally to forward our paperwork for my neutralization.

My question is: do i need to fill out form i864 or not? I was out of status before i got married...so i it is not a family based immigration thing.

hi

you don't fill it out, your wife does, the i864 is for the petitioner, she has to show the government that you won't become a public charge, she has to make enough and file taxes to file for you, if she doesn't meet the poverty guidelines, then she will need a joint sponsor

you are filing to be a legal permanent resident by being married to a USC

hi

has you wife been filing taxes? unless she doesn't qualify because she doesn't make the minimum, a USC must file taxes

if she didn't qualify, she must write a letter and attach it with the i864, explaining why she why

the joint sponsor will have to send the taxes with the i864, proof of citizenship or being a legal permanent resident, paystubs, letter of employment and W2s if needed

it is all in the instructions of the i864, read the instructions thoroughly
