Topic says it all. This is concerning a friend of mine who is curious whether the two month rule that applies to K1 Visa Adjustment of Statuses applies here as well.

what is a '2 month rule' ?

I ask, cause I paid attention to this stuff, almost 8 years now.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Please note, Igor's stat only refer to the specific form processing, i.e., EAD, AP, not whether it is filed with AOS.

***** Moving from Tourist Visa to AOS from Tourist Visa forum *****

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I join the others in being very interested in what this supposed 2 month rule is.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

I think it's the 30/60-day "rule", where some people say to wait that long after entering the US on B2 or F1 before filing AOS to avoid issues of "visa fraud". (I think we frequently tell people there is no such rule.) In any case, K visa, is, by definition, not subject to immigrant intent with respect to immigrating through the USC spouse, because that's what the K visa is for.

By two month I am referring to, absent RFEs and the like, the 2-ish month waiting period from point of filing for an AOS, to the receiving of the Parole/Work Authorization Card. Not a rule by any means, just the general number I have seen posted on this site.

Anyway, does this same time frame apply to those attempting to adjust status from a Tourist Visa?

In that case 2-3 months, yes.

AOS from a B-2 may take longer as you'll fall under more scrutiny and it's an increased chance of RFEs.

I hope it go by 2 months! I filled for AOS end of January and had my Biometrics take yesterday (01/11).

Someone I know got it all done in 2months and half.
