My fiance's affidavit of support was declined. Can she still be a Co-Sponsor on the i864?

Hi guys,

I have 2 questions if you know, please answer.

I recently received this email from the Consulate here in South Africa:

Dear Mr. Mouton.

Kindly be advised that your Petitioner’s affidavit of support does NOT meet the poverty guidelines (poverty guidelines attached). Therefore, you need a Co-Sponsor. Once you have your Co-Sponsor’s I-864 and current tax returns, please submit them to us for further processing of your application.

1 - My question is that since they are now asking for a i864 could my fiance still be a sponsor along with a co-sponsor on this document?

2 - Her mother is on Social Security income and earns $1600 per month, would she be able to be a co-sponsor on this document?

1 - My question is that since they are now asking for a i864 could my fiance still be a sponsor along with a co-sponsor on this document? Your fiance/husband will file an I-864 as the petitioner even though he does not meet the poverty line. He will always be first in line. The co-sponsor (Joint Sponsor) is secondarily with her own I-864. responsible.

2 - Her mother is on Social Security income and earns $1600 per month, would she be able to be a co-sponsor on this document? No. That's only $19,200 a year for a household of 2. She would need to use assets; about $4000. This is not a strong Joint Sponsor IMHO.

Her mother has a car which would be valued at more than $4000 & my fiance also has a car valued at $9000. Would this help our case?

So does each one of the sponsors need to earn over $19912 individually?

No, cars are considered necessary and thus not usually allowed for assets, unless the person owns two cars; same with property, your primary home usually doesn;t count, but a rental/ holiday home would.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Their cars do not count.

Their income can not be combined. Either must earned enough for at least a household of 2.
