Filed taxes as single- problem? (split and merge)

hello everyone i going thr the same thing and now i am so fustrated ,, :( we filled w2 and irs as a single and the interview at the consult after few days and we can't do nothing about it ,, we called the irs already many time tried to explain that we are married but but they keep asking are ur spouse in US ? no . are he or she ever been in US ??? no are ur spouse ever work in US or file or any kind of income tax ?? no ,, and was the answer was so u have to sign it as a "single" and even there at the office where we fill the 2015 W2 the lady asked the same questions and the answer was NO in everytime so she sign it as "single" herself and she said that they could change this only when ur spouse be there and have a SSN ,, now i dont know if the CO will mention this in the interview and what i should say ? and if i can explain that to him ??? or if i will face any kind of AP for this thing plz help me cuz i see here some saying "YES" and other say "NO" and i wander if anyone face any kind of problem cuz this issue ??

I have the same issue, but the irs officer told me that I can't fill as married because my wife never been in usa and does not have a social security number,did you already pass the interview?

Hi! Im already in the US now. My husband filed as single during the whole petition process as i dont have ssn, never been and doesnt work in the US. Questions about this was not asked in my interview and I got my visa 4days after interview. Flew to US and last February I got my Ssn and filed my husband's taxes as married filing jointly. We didnt had any problem at all.

Hi all I m New to this forum I have 2 question on my w2 and taxes transcript my status is single,but u petitioned my wife who life in Congo in Africa and never been to usa,so she doesn't have a social security, and I can't not filled as married filling separately, Will it be a big problem for the interview, my second question is to know if all f2a need Cenomar?

I think you should start filing as" married, filing single". That's what I will be doing this year unless hopefully my husband is here before then. I don't think it should be a problem but others said people like myself and Yourself should have filed married. I decided to filed married after I petitioned for him(this year).

Wrong. This is tax fraud. You must file as married filing separately. An itin may be obtained in place of a ssn

How is it fraud? I live alone in this country, work alone, have single source income so tell me how this is fraud? Our spouses are like a ghost in the USA document, in fact they're imaginary husbands/wives to the US government. Until I petition for him or put him in any legal document here, he doesn't exist in the USA. Yes I'm filing married after I have petitioned for him. Edited by Caykay1

Because you're not single, you're married. Single/married is a legal status. If you're married elsewhere you're mRried in the USA

Stop stressing yourself because you have no reason to. Being nervous can interrupt your interview. You are digging for problems yourself. I doubt they will ask about taxes in the interview. Highly doubt and if they may ask if you pay your taxes regularly and I guess you do. In case they do simply say you file as single since you're alone here and do everything as single because your marriage is outside the USA. I highly doubt they will ask about this question. STOP STRESSING before you voluntarily commit yourself. Edited by Caykay1

Because you're not single, you're married. Single/married is a legal status. If you're married elsewhere you're mRried in the USA

You can interprets it how you want. Like I said earlier it is not fraud. I only will file married this coming tax season.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
