Hi good morning I have lots of questions I was married to an American man,I got my 10 yr greencard , we been married for over 4 years in the US , our marriage was in good faith and we had a baby , we didn't get along together and he asked for a divorce , do I have to inform the USCIS if we divorce ? I have been a residence for over 4 years , I would like to apply for citizenship , will I be permitted to do that ?or will the divorce meant they will refuse my application in the future ? What is going to happen when(if) I apply for American citizenship in the future ? How many years I can apply American citizenship?will that affect my 10 yr green card? I need help thanks

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You do not need to inform USCIS about your divorce. Divorce does not affect your 10 year green card.

You can not use the 3 years rule for US citizenship with a divorce.

You can apply under the 5 years rule for US citizenship. So, 5 years with a green card and you can apply. Your divorce will not matter.

Thanks for the reply , I have another questions , I been a green card holder since 2012 and will be expired until 2024, can I remarried or I need to wait to remarried for another 5 years after I apply American citizenship? Thanks

Strange question. Is there currently someone you are seeking to marry or is this just 'what if'?

The basic answer is you are a permanent resident whose card expires in 2024. You can divorce and the only impact it will have on your status is you have to wait until 5 yrs have passed since your card was issued to naturalize.

You are free to remarry after the divorce at any point. Complications can arise depending on when you remarry. If it is immediately or soon after the divorce it can be an issue at naturalization as they will see the dates and it will cast suspicion on the bonafides of the marriage you adjusted with. If your new spouse is in need of immigration benefits and obtains them through you- again it can cast suspicion on the bonafides of the prior marriage and can cause issues in getting the new spouse an approval.

I also want to point out there is no official time frame of how long after a divorce will a remarriage look suspicious. You need to use common sense. A very common issue is people overlapping claims. For example submitting proof for ROC stating you had a bonafide marriage from 2012-2014 then divorcing and submitting proof you and the new spouse have a bonafide relationship by showing or stating involvement since 2013.

Hello thanks for the reply , not gonna remarried after the divorce !!! I still love my husband , but his mind is fix and planning to divorce me , he had been married 6 times , I tried to save our marriage and offer him a counseling but he refused I don't have a choice but to agree with him and we do have a baby , my questions is in the future can I remarried? And I don't have somebody , I'm just talking about the future , thanks a lot

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You can keep your married name. A divorce lawyer can answer these questions for you.

'change of name' only occurs during the divorce proceedings, and is mentioned in the divorce filings (petition, response(s ), decree) . it does not automatically revert - it must be mentioned in the divorce filings.

So, if you NOT want to change your name, you don't have to !

So, if you NOT want to change your name, you don't have to !

I've never understood this. In Canada I was able to change my legal name whenever I wanted to. They see it as your birth name is rightfully yours so you can use whatever you like. I switched my ID back to my maiden name during my separation.

Thanks for the reply , if I change my last name back when I was single after the divorce it not match in my DRIVERS license and greencard , Coz I heard that if I divorce I don't need to inform the USCIS since I am a 10 years card holder ,they said they can't take that away from me specially we had a baby with my husband !!!! Coz if I change my last name I'm thinking it just complicated for me since my legal name here in US is the name of what's written in my green card and that if I apply another job they won't question my name , I'm very confused , thanks
