We have our K1 visa and have set dates for me to fly over however due to some family emergencies that have arised we aren't sure if doing the marriage right now is best.

To keep it short, can I come out to states seeing as everything has been paid for, leave within the 90 days which yes, would expire my K1 visa but still be able to come out on the ESTA for future visits until we re-apply for the K1 Visa?

Why not just do a simple courthouse marriage and then you have years to do the AOS and just pay to do Advance Parole and ur able to come back and forth

So.. you're saying we could Marry, then I apply for Advanced Parole but not AOS? Would that not make me staying illegal by not starting the AOS process?

I heard after you get married you can do the AOS when you like when you have the money the 90 days only pertains to actually getting married

Honestly best thing to do so you can save money in the long run an not have to see if you will get approved cuz you might not be lucky on the second time

So I could apply for AOS anyway in that case while I am there... do you know how long it takes to receive an Advanced Parole so Id know how long i'd be waiting after applying?

The most it will take is 3 months but I seen people getting it less then 3 months, from what I hear you could ask for Expedeiate (I think that's how you spell it) if you need it sooner

Fraud on a tourist visa...unless you mean doing so in a k1

The OP did state he is on a K1 visa so it's not fraud

The OP did state he is on a K1 visa so it's not fraud
